국문 초록

본고는 ‘성적 지향’ 용어의 의미론적 변화와 재맥락화를 차별금지법안과 교도권 문헌 안에서 확인하는 계보학적 연구이다. 주디스 버틀러(J. Butler)가 Excitable Speech에서 다루고 있는 ‘성적 지향’ 발언 금지에 관한 논의가 법안들과 동성애자 사목에 관한 교회의 가르침을 이해하는데 어떤 도움을 제공할 수 있는지 살피는 것이다. 버틀러는 동성애자 사목에 관한 주제를 다룬 적이 없지만, 본고는 교도권 문헌 안에서 ‘성적 지향’의 개념이 재배치되는 순간을 확인하기 위해, 버틀러의 언어 수행성 이론을 비판적 방법론으로 사용한다. ‘성별정체성’과 ‘성적 지향’의 설명이 처음으로 등장한 법안은 노회찬법(2008)이고, ‘성적 지향’의 발언과 ‘동성애 행위’를 같은 수준에서 이해한 법안은 장혜영법(2020)이다. 동성애적 ‘경향’에 대해서 처음으로 언급한 교도권 문헌은 ｢성윤리상의 특정 문제에 관한 선언｣(1975)이지만, 동성애적 성향을 ‘객관적 무질서’로 명시한 교회의 가르침은 ｢동성애자 사목에 관하여 가톨릭 교회의 주교들에게 보내는 서한｣(1986)이다. 본고는 가족들 가운데 동성애적 성향을 경험한 이를 둔 가정의 상황을 언급한 ｢사랑의 기쁨｣ 안에서 ‘성적 지향’이라는 용어가 재배치되고 있음에 주목하면서, 동성애자 사목에 관한 교회의 가르침 안에서 ‘재맥락화’ 현상을 확인한다.

영문 초록

This article is a genealogical study to identify the semantic shift of term ‘sexual orientation’ and its recontextualization within legislative proposals on the anti-discrimination and Magisterial documents. This explores how Butler’s debate on the prohibition of speech sexual orientation in Excitable Speech contributes to our understanding of legislative proposals and Church’s teaching on the ministry for homosexual persons. While Butler did not directly address the subject of the ministry for homosexual persons, this study uses her theory of language performativity as a critical methodology to capture the moment when a concept of ‘sexual orientation’ underwent a reversal in Magisterial documents. The legislative proposal that first addressed gender identity and sexual orientation is No Hoechan’s (2008), and the proposal that understands speech ‘sexual orientation’ and ‘a homosexual act’ at the same level is Jang Hyeyeong’s(2020). Magisterial document that initially dealt with homosexual tendency is Persona Humana (1975), and the Church‘s teaching that refers to homosexual tendency as ’objective disorder’ is found in Homosexualitatis Problema (1986). Highlighting the redeployment of the term ‘sexual orientation’ in Amoris Laetitia, which addresses the situation of families with members experiencing same-sex attraction, this study confirms a phenomenon of recontexualization in the Church’s teaching on the ministry for homosexual persons.
