법 조항을 통해서 본 심리상담의 현실과 과제

국문 초록

본 연구에서는 심리상담의 법적 토대가 아직 마련되지 못한 현실을 돌아보며, 이미 영유아, 아동, 청소년, 노인 등 상담 및 복지 서비스가 필요한 이들을 위해 설치된 지역사회의 공공기관들이 준수하고 있는 법들을 알아보았다. 그 결과 다양한 대상의 복지 향상을 위해 제정된 법들은 공통적으로 사회복지사업법을 근거로 하고 있었고, 종사자 채용조건에는 공통적으로 사회복지사 자격증 소지자가 포함되어 있었다. 한편 서비스 대상자에게 제공되는 상담이 무엇인지 살펴보기 위해 사회복지상담과 심리상담의 정의를 비교하고, 심리상담의 직무를 국가 차원에서 분석한 국가직무능력표준(NCS)의 결과와 문제점들을 지적하였다. 결론적으로 국민의 행복과 성장을 위해 국가가 제공하는 상담 및 복지서비스는 사회복지사업에 국한된 사회복지서비스에서 사회서비스로 확대되어야 하고, 이를 위해 서비스 제공자의 채용조건도 다양해져야 한다고 보았다. 상담 및 복지 분야에서 공공기관의 인력 채용조건을 개정해야 필요성은 첫째, 다른 학문 분야에서 상담 및 복지를 전공한 졸업생의 사회복지현장 취업 기회를 제한하여 기본권을 침해할 소지가 있고, 둘째, 서비스 대상자의 다양한 요구와 개별적 특성에 부합하는 사회서비스를 제공하기 위해 법 개정을 검토해야 한다는 점을 언급하였다.

영문 초록

This study explores the absence of a legal framework for psychological counseling, focusing on legislation in public agencies across local communities that serve various demographics, including infants, children, adolescents, and the elderly. It finds that most legislation relies on the Social Welfare Services Act, requiring social worker certification for employment. Moreover, to define the nature of counseling services offered to recipients, the study compares the definitions of social welfare counseling and psychological counseling. This study critiques the results and issues identified in NCS, which analyze the job competencies of psychological counseling at a national level. Conclusively, it argues that counseling and welfare services national provided should not be limited to social welfare but expanded to encompass broader social services. This expansion necessitates diversification in the hiring conditions of service providers. The need for revising the employment conditions in public agencies in the counseling and welfare sector is discussed, emphasizing two points: firstly, restricting employment opportunities in the field of social welfare for graduates who majored in counseling and welfare in other academic disciplines may infringe upon their fundamental rights, and secondly, considering revisions is essential to provide social services that meet the diverse needs and individual characteristics of service recipients.
