캐나다 재범감소기본법의 제정배경과 추진 전략의 시사점에 관한 연구

국문 초록

이 연구는 캐나다가 2021년에 제정한 재범감소기본법의 제정배경 및 2022년에 발표한 재범감소전략의 주요내용을 세세하게 살펴보고 그 시사점을 찾아보는 데 목적을 두었다. 연구결과 다음과 같은 시사점을 도출하였다. 첫째, 캐나다는 연방정부 및 지방정부가 당면한 교정시설 문제 및 출소자 재범 문제 등의 다양한 요인들을 정확하게 진단하고, 그에 맞춘 해결책을 찾으려 하였다. 둘째, 캐나다 의회와 정부가 교정처우의 문제를 공유하고 입법과 정책을 연계함으로써 보다 전략적으로 문제를 해결하려고 노력하였다. 셋째, 재범감소기본법은 재범감소전략의 우선순위와 계획을 세우는 과정에서 연방 및 지방정부의 의견을 조율하도록 규정함으로써 연방과 지방정부의 입장이 상호 반영되고, 보다 현실적인 정책들이 제시될 수 있도록 하였다. 넷째, 출소자들의 지역사회 정착을 위해서는 주택문제의 해결이 필수적이라는 점을 강조하고 대책을 제시하였다. 다섯째, 출소자의 고용과 안정적인 취업지원을 위하여 교정시설 내 교육과 견습생제도 등을 체계적으로 연계한 직업훈련 시스템을 갖췄다. 여섯째, 범죄기록법을 개정하여 범죄자의 전과기록공개를 정지시킴으로써 범죄자의 취업과 주택마련 등을 용이하게 하도록 했다. 일곱째, 출소자가 교정시설에서와 같이 의료지원서비스를 받도록 건강관리시스템을 갖추었다. 여덟째, 이 전략은 출소자가 지역사회에서 단절되지 않고 긍정적 지원 네트워크를 가질 수 있도록 사회적 관계 맺기를 지원토록 하였다.

영문 초록

The purpose of this study was to examine in detail the background of the Reduction of Recidivism Framework Act enacted by Canada in 2021 and the main contents of the Federal Framework to Reduce Recidivism announced in 2022 and find its implications. As a result of the study, the following implications were derived. First, Canada attempted to accurately diagnose various factors faced by the federal and provincial governments, such as problems with correctional facilities and recidivism among released prisoners, and find solutions tailored to them. Second, Canada Congress and the government shared the problem of correctional treatment and tried to solve the problem more strategically by linking legislation and policy. Third, Reduction of Recidivism Framework Act stipulates that the opinions of the federal and local governments be coordinated in the process of establishing priorities and plans for recidivism reduction strategies, so that the positions of the federal and local governments are reflected and more realistic policies can be presented. Fourth, it was emphasized that solving the housing problem is essential for released prisoners to settle down in the community, and measures were presented. Fifth, in order to support the employment and stable employment of released prisoners, a vocational training system including education and apprenticeship system within correctional facilities has been systematically established. Sixth, the Criminal Records Act was revised to suspend the disclosure of criminal records(Record Suspension), making it easier for criminals to find employment and housing. Seventh, a health care system was established so that released prisoners could receive medical support services in the community as well as in correctional facilities. Eighth, this strategy supports social relationships so that released prisoners can have a positive support network without being cut off from the community.
