국문 초록

논문의 주제는 교회법에서 법인격을 부여받은 단체의 재산 관리를 위임받은 관리자이다. 교회법 제1284조는 ‘선량하고 근면한 가장’(bonus o diligens pater familias)의 모습을 관리자의 모델로 제시하고 있다. 교회 재산의 모든 관리자는 제1284조 제1항의 규범에 따라 “선량한 가장의 근면함”으로 자신의 임무를 수행할 도덕적 · 법적 의무가 있다. 선량한 가장의 모델은 일반적이고 추상적인 사람의 이미지가 아니라, 그것은 모든 형태의 불안정성을 배제하는 헌신, 정확성, 책임감 및 신중함, 정직성, 충실성을 강조하기 위한 교회의 전통적인 방식이다. 우리는 이 연구를 통해 관리자의 정체성을 명확히 하고, 전통적으로 교회가 관리자에게 요구하는 근면의 정도에 대해서 살펴보고자 한다. 이를 위해서는 무엇보다도 공법인과 관리자 사이의 관계를 파악하는 것이 중요하다. 궁극적으로 관리자의 관리 권한의 원천을 나타내는 관계에 정확한 법적 근거를 제공할 필요가 있기 때문이다. 이 연구를 통해 우리는 선량한 가장의 근면함(diligentia boni patrisfamilias)에 대한 교회의 전통적인 해석이 외형상 조문에서 드러나는 것보다 훨씬 더 심오한 의미를 닮고 있다는 사실을 알 수 있다. 특히 우리는 근면성의 역동적인 의미와 함께 교회 현실의 특수성을 이해할 수 있다.

영문 초록

The subject of this thesis is the administrator entrusted with the administration of temporal goods of an organization that has been granted legal personality by canon law. Canon 1284 presents the model of an administrator as a ‘good and diligent householder’(bonus o diligens patrisfamilias). All administrators of the temporal goods of the church have a moral and legal obligation to carry out their duties with the ‘diligence of a good householder’ according to the norm of can. 1284, §1. The model of a good householder is not an image of a person who is ordinary, abstract, but it is the Church's traditional way of emphasizing devotion, accuracy, responsibility prudence, honesty and fidelity, excluding all forms of instability. Through this study, we will clarify the identity of an administrator and consider the degree of diligence traditionally required of administrators by the church. For this, it is important to understand the relationship between the public legal personality of the Church and the administrator above all. Ultimately, this is because there is a need to provide an accurate legal basis for the relationship indicating the source of the administrator's administrative authority. Through this study, we will be able to understand that the church's traditional interpretation about the ‘diligence of a good householder’(diligentia boni patrisfamilias) resembles a much more profound meaning than is revealed in the surface of the norm. In particular, we will be able to understand the specificity of church reality as well as the dynamic meaning of diligence.
