지방자치단체의 사무구분체계에 관한 공법적 고찰

국문 초록

이 논문은 2012년 지방자치법 개정안을 현재의 시각에서 재평가하고, 일본과 독일의 사무구분체계에 관한 비교법적 검토를 통해 법정수임사무 도입을 포함하여 사무구분체계 개편의 방향을 제시하는 것을 내용으로 한다. 위임사무의 폐지와 국가사무-자치사무로의 사무의 이원화 등 사무구분체계의 정비는 법률인 「지방자치분권 및 지역균형발전에 관한 특별법」에서 규정하고 있는 과제이며, 지속적인 검토가 필요한 주제이다. 그러나 사무의 이원화를 추진함에 있어 국가사무와 자치사무의 경계영역에 있는 사무로서 지방자치단체가 수행하되 국가 전체적인 통일성이나 국가에 의한 적정성 확보가 필요한 사무의 영역을 어떻게 체계화하고 규율할 것인지의 문제가 남게 된다. 지방자치단체의 사무구분체계는 사무수행에 있어서 지방자치단체의 자율성, 국가의 감독권 행사, 자치권 침해에 대한 권리구제, 지방의회에 의한 통제 등 지방자치제 전반에 관련된다. 따라서 지방자치단체가 수행하되 국가 전체적인 통일성이나 국가에 의한 적정성 확보가 요구되는 사무의 영역이 불가피하게 존재한다면 그러한 사무의 설정기준과 기관위임사무와의 차별성, 즉, 어떠한 정도의 자율성과 국가에 의한 관여가 적정한지에 대한 면밀한 설계가 필요하다. 또한 국가의 관여에 대한 지방자치단체의 권리구제수단 역시 이에 대응하여 정비될 것이 요청된다. 2012년 지방자치법 개정안의 법정수임사무는 이러한 경계적 성격을 갖는 사무에 관한 법적 규율체계를 정비하기 위해 도입이 검토되었으나, 그 명칭에서부터 사무구분의 기준, 법적 근거, 지방자치단체의 자율성과 국가의 관여 및 자치권 침해에 대한 권리구제 문제 등에 대해 많은 비판적 논의가 제기되었다. 이러한 쟁점들에 대한 일본과 독일의 법제 및 논의는 우리에게 시사하는 바가 크다고 생각된다. 일본의 법정수탁사무 또는 독일의 지시에 의한 의무사무와 같이 경계적 성격을 갖는 사무의 기준 및 유형의 법적 근거를 법률에 두고, 이러한 사무에 대한 지방자치단체의 자율성과 국가의 관여의 정도 및 지방자치단체의 권리구제방안 등에 대한 법제를 정비하는 것을 적극적으로 검토할 필요가 있다. 위임사무의 폐지와 국가사무-자치사무로의 이원화가 법률이 규정하고 있는 과제인 만큼 앞으로 국가와 지방자치단체간 사무구분체계에 대한 논의가 활성화되어 지방자치단체의 자치권을 보다 실질적으로 보장할 수 있는 법제의 개선이 이루어질 것을 기대한다.

영문 초록

The purpose of this paper is to reevaluate the 2012 amendments to the Local Government Act from the current perspective and to suggest directions for reorganizing the system for classification of administrative affairs, including the statutory assigned affairs, through a comparative legal review of the legal system in Japan and Germany. The overhaul of the system for classification of administrative affairs, including the abolition of delegated administrative affairs and the division of affairs into state and autonomous administrative affairs, is a task stipulated by the Special Act on Local Autonomy and Decentralization and Restructuring of Local Administrative Systems, and is a topic that requires continuous review. However, in promoting the dualization of affairs, there remains the issue of how to systematize and regulate the areas of affairs that are on the borderline between state and autonomous administrative affairs, which are carried out by local governments but require national uniformity or adequacy by the state. The system for classification of administrative affairs relates to the entire local government system, including the autonomy of local governments in carrying out affairs, the content of the state's supervision, remedies for infringement of autonomous authority, and control by local councils. It is necessary to carefully design the criteria for setting tasks that are performed by local governments but require uniform discipline by the state, and what degree of autonomy and state supervision is appropriate in contrast to agency-delegated administrative affairs. In addition, local governments' authority and remedies against state aupervision need to be established in response. The legal systems and discussions in Japan and Germany on these issues provide us with many implications. It is hoped that the discussion on the system for classification of administrative affairs will be enriched, leading to improvements in legislation that will more practically guarantee the autonomy of local governments.
