영국의 지방자치제도 발전과정에 관한 고찰

국문 초록

지방자치제도의 발전과 성숙을 위한 문제해결방법론은 매우 다양하겠지만, 그 무엇보다도 해외 선진국의 방법론을 확인하는 것은 그 의미가 크다고 하겠다. 이 글에서는 영국의 지방자치제도의 연혁과 발전과정을 살펴봄으로써 우리 지방자치제도 개선의 실마리가 될 수 있는 부분을 확인하고자 한다. 특히 영국 지방정부의 생성과 발전 등 영국의 행정체제의 유연한 개편을 통한 지방자치제도의 실질적이고 실용적인 운영의 역사는 우리의 지방자치제도의 개선에 있어 시사하는 바가 크다. 영국 의회는 각 지역의 의회에 입법권한을 부여하는 것을 내용으로 하는 각 지역 법률을 제정함으로써 각 지역에 자치입법권을 제도적으로 보장하였다. 영국의 지방분권에 있어서 입법분권 모델 역시 자치입법권의 실현과 보장을 검토하는 우리에게 참고할 만한 입법례라 할 것이다. 중앙과 지방의 관계에 있어서 영국에서 시행한 지방 공공서비스 협약제도는 중앙과 지방의 대등한 관계를 통하여 자율성과 책임성을 확보하는 제도이다. 중앙집권적 시장경제주의의 시행착오를 경험하고 이를 극복하기 위하여 연방주의적 분권법을 제정하고 시행하면서 불문헌법국가임에도 지방분권, 재정분권을 점진적으로 안착시키고 지방자치와 지방분권에 있어서 성숙의 단계로 접어들고 있는 영국의 지방자치모델은 현재 우리의 지방자치가 당면하고 있는 여러 문제상황을 극복할 수 있는 기제로 검토할 수 있다. 영국의 지방자치법제 발전과정에서 나타났던 기관구성의 다양화, 지방의회의원의 책임성 강화 조치는 최근 우리 지방자치법 개정 때 신설되었다. 단일국가로서 여러 상황과 조건이 유사한 영국의 지방자치제도 발전 모형은 우리나라에서 충분히 참조할 만하다고 생각한다. 최근 지방자치제도의 발전적 시행이 국가적 사회적 과제이니만큼 영국에서 이미 시행했고 성공적으로 안착시킨 실용적 행정체제의 개편, 지역 법률의 제정을 통한 자치입법권의 부여, 중앙과 지방간의 협약과 평가를 통한 자치권의 합리적 이양 등은 우리 지방자치제도에 맞게 계수하는 방안도 적극적으로 검토할 필요가 있다.

영문 초록

Problem-solving methodologies for the development and maturation of local self-governance systems may be very diverse, but it is more meaningful to check the methodologies of advanced countries overseas than anything else. In this article, we will examine the history and development process of the British local self-governance system and identify areas that can serve as a starting point for improving our local self-government system. In particular, the history of practical and practical operation of the local self-government system through flexible reorganization of the British administrative district system reorganization, including the creation and development of British local governments, has significant implications for the improvement of our local self-government system. The British Parliament institutionally guaranteed autonomous legislative rights to each region by enacting regional acts granting legislative authority to each region's parliament. The model of legislative decentralization in the UK's local decentralization can also be considered a legislative example that can be used as a reference for us as we examine the realization and guarantee of self-governing legislative rights. In the relationship between the central and local governments, the local public service agreement system implemented in the UK is a system that secures autonomy and responsibility through an equal relationship between the central and local governments. Experiencing the trials and errors of centralized market economics, and in order to overcome them, the federal decentralization law was enacted and implemented, and despite being a country with an unwritten constitution, local decentralization and fiscal decentralization were gradually established and local autonomy and decentralization entered a mature stage. The British local autonomy model can be reviewed as a mechanism to overcome the various problems our local autonomy is currently facing. Measures to diversify the composition of institutions and strengthen the responsibility of local council members, which appeared during the development of the UK's local autonomy legislation, were newly established in the recent revision of our Local Autonomy Act. It is believed that the UK's local autonomy system development model, which has similar situations and conditions as a single country, is worthy of reference in Korea. Recently, as the progressive implementation of the local autonomy system has become a national social agenda, the reorganization of the practical administrative system that has already been implemented and successfully established in the UK, the granting of autonomous legislative rights through the enactment of local Acts, and the granting of autonomous rights through agreements and evaluations between the central and local governments. There is a need to actively review measures to account for reasonable transfers in accordance with our local autonomy system.
