전시(戰時) 입법과 전쟁 대응에 대한 공법적 검토

국문 초록

전쟁과 법은 주로 국제법적 관심사였으나, 지속적인 북한의 도발, 러시아와 우크라이나 전쟁, 이스라엘과 하마스의 전쟁 등으로 국내 공법적 관심도 가져야 할 필요가 있다. 전쟁 시 국민의 권리와 의무에 큰 영향을 미치는 전시 대비 법제는 아직도 미비한 부분이 많다. 본 연구에서는 6.25 전쟁 당시의 긴급명령 등 전시입법을 통해 전시 대비 법제의 개선 쟁점을 분석하고, 국민의 생명과 재산을 보호하기 위한 법적 대비를 위한 시사점을도출하고자 하였다. 6.25 전쟁 당시 긴급명령과 유사한 규정이 현재 법률에서 마련된 것도 적지 아니한데, 다수의 긴급명령을 만드는 것보다 현재 필요한 내용을 미리 규정하는 것은 바람직하다고 할 수 있다. 그런데 행정부에서 전시대기 법률(안)과 긴급명령(안)을 마련하고 있는데, 이는 민주주의 관점에서 문제가 적지 않다. 행정부가 아닌 의회에서 관리하도록 하거나, 해당 내용이 꼭 필요한 것이라면 국민이나 관계 공무원의 예측가능성을 위하여 미리 법률로 제정할 필요가 있다. 전쟁의 대응을 위해 전쟁이 발생한 뒤가 아닌 전쟁이 임박한 시점에서 효력을 발하는 내용이 필요한데 이러한 대응을 위한 시점을 개념화하는 것이 필요하다. 나아가 현대전에 맞추어 경제적인 대응이나 과학기술적 대응에 있어서 법적 과제도 계속 검토하여야 할 것이다. 이러한 사항들을 고려하여 전쟁을 대비 한다면 전시 상황에서 국민의 생명과 재산을보호하고 국가의 존립을 수호하는 데 크게 기여할 수 있을 것이다.

영문 초록

War and law have been primarily a concern of international law, but sustained North Korean provocations, the war between Russia and Ukraine, and the war between Israel and Hamas have made it necessary to have domestic public law concerns as well. In times of war, wartime readiness legislation, which has a significant impact on the rights and obligations of citizens, is still incomplete in many areas. This study analyzes the issues of improving wartime readiness legislation through wartime legislation such as emergency orders at the time of the Korean War, and attempts to derive suggestions for legal readiness to protect the lives and property of the people. Although many of the same provisions as the emergency order at the time of the Korean War have been established in current legislation, it is preferable to prescribe in advance the contents currently required rather than creating numerous emergency orders. However, the executive branch has prepared the draft War Standby Law and the draft Emergency Order, which are not less problematic from the standpoint of democracy. Either they should be administered by Congress rather than the executive branch, or if their contents are absolutely necessary, they should be enacted by law in advance for the predictability of the public and the public officials concerned. For the response to war, the content needs to take effect at the time war is imminent, not after it has occurred, but it is necessary to conceptualize the point in time for such a response. In addition, legal issues in economic and scientific and technological responses tailored to modern warfare should continue to be considered. Taking these matters into account in preparing for war would go a long way toward protecting the lives and property of the people and safeguarding the nation's existence in a wartime situation.
