방치선박 해결을 위한 법제 개선 방안

국문 초록

최근 들어 노후선박, 특히 FRP 재질의 선박이 섬 지역이나 해안가는 물론 내륙지역까지 방치되어 환경적으로 미세플라스틱 발생, 폐유 유출 등의 해양 환경오염의 문제점이 자주 부각되고 있다. 이 연구는 무단방치 선박으로 인해 정부가 직권제거 등으로 처리비용이 발생하는 등 사회적 문제가 지속적으로 제기되는 상황에서 현행 관련법령을 조사, 분석, 검토하여 법제 개선방안을 제언해 보고자 하며, 이를 위해 방치선박의 발생현황과 폐선절차, 지방자치단체의 처리현황을 알아보고 현행 법령에 대한 종류와 개별 법령에서 방치선박과 관련된 조문을 검토하여 법의 실효성 등의 문제점과 그에 대하여 개선하기 위한 방안을 도출하였다. 아울러 국외, 프랑스 사례의 관련 문헌을 조사하여 그 내용을 비교분석하였고, 마지막으로 방치선박의 관련법령을 법률적으로 검토하여 법제 개선방안에 대하여 제안하였다.

영문 초록

Recently, Old boats, particularly FRP (Fiberglass Reinforced Plastics) boats, are intentionally abandoned in island, coastal, and even inland areas on various purposes. This causes marine environmental pollution, such as microplastic generation and oil spillage. Unauthorized abandoned vessels continue to raise social issues, such as marine pollution, removal costs by the authority. Against this backdrop, our study intends to suggest ways to improve the existing legal system by investigating, analyzing, and reviewing the related laws. For this purpose, we delve into the current status of vessel abandoning practices, the process of vesssel disposal and the policies of local governments. Also, this paper reviews the types of current laws and regulations related to abandoned vessels, identifies areas for improvement such as legal effectiveness. Furthermore this paper includes case study of the practices with a particular focus on France. Lastly, this study proposes measures for legal system improvement by reviewing the relevant laws and regulations on abandoned vessels.
