마리나항만 이용활성화를 위한 마리나항만법 개선방안 연구

국문 초록

우리나라는 최근 20년 동안 마리나선박을 이용한 해양레저활동에 관한 수요 가 지속적으로 증가하고 있다. 반면, 마리나선박을 계류·보관하는 마리나항만 및 관련 시설은 증가하는 수요에 맞게 조성되지 못하고 있다. 정부는 이러한 문제를 해결하기 위해 2009년 ｢마리나항만의 조성 및 관리 등에 관한 법률｣(이하 ‘｢마리나항만법｣’이라 한다)을 제정하고 마리나 관련 산업을 정책적으로 육성하고자 하고 있지만 실무에서는 마리나항만법이 아닌, 다른 개별 법령에 근거하여 조성·운영되고 있어 ｢마리나항만법｣에 근거하여 마리나항만 이용이 활성화할 수 있게 법률 개정이 필요한 시점이다. 이를 위해서는 우선적으로 ｢마리나항만법｣의 제도적 실효성을 제고할 수 있도록 마리나선박의 정의를 등록·검사와 연계하여 명확하게 규정하는 것이 필요하고, 소규모 마리나항만 등의 개념을 도입하여 개별 법령에 근거한 다양한 규모의 마리나항만을 통합적으로 관리하는 것이 요구된다. 뿐만 아니라 마리나항만 개발 사업제안자의 법적 지위를 명확히 하도록 사업계획 승인 규정을 변경하고, ｢마리나항만법｣이 마리나항만 및 관련 시설의 개발·이용에 대한 기본법임을 명시함으로써 ｢마리나항만법｣에 따른 마리나항만의 원활한 조성과 이용활성화가 필요하다. 이러한 개정은 마리나항만 전체의 합리적인 개발 및 이용에 관한 근간이 될 것으로 생각되며, 이후 증가하는 해양레저 활동자에게 충분한 인프라 제공을 위한 제도적 틀을 제공할 것으로 판단된다.

영문 초록

The Republic of Korea has experienced continuous increase of demand on marine leisure activities in recent 20 years. However, the development of marina and its facilities in which marina ships are moored and stored would not meet the increased demand. In order to address such issues, the government of Korea legislated in 2009 the Act on the Development and Management of Marinas (hereinafter referred to as the Marinas Act) and began to foster marina industries as a policy matter. Nevertheless, in practice, a number of marinas has been developed on the basis of legislation other than the Marinas Act, and at the moment the reform of the Marinas Act is necessary in order to promote use of marina which is constructed based on the Marinas Act. In particular, the definition of marina ship under the Marinas Act should be revised more specifically in terms of its registration and safety survey, ensuring effectiveness of the regime. Also, marina from various legislation should be managed in an integrated manner by introducing the definition of small marina into the Marina Act. In addition, the regulations about the approval for the business plan of the marina development should be amended ensuring legal status of the project implementer and the Marina Act should be provided expressly as the basic law for the development and use of marinas and their facilities so as to promote the development and use of marinas based on this law. Such reforms can be considered as providing the basis for comprehensive development of marina as a whole and also providing institutional framework in order for meeting the growing demand for marina.
