선원근로감독관제도의 제문제 및 개선 방안 연구

국문 초록

사업장의 근로감독은 관련 노동법의 정의를 실질적으로 구현하고 노동자의 근로조건과 안전보건을 보호함으로써 사회적 안전을 달성하기 위한 국가 행위의 하나이다. 이와 같은 국가 과제의 실질적인 수행은 근로기준법상의 근로감독관을 통해서 이루어지고 있으며 선원법의 적용을 받는 선박(사업장)과 선원은 선원근로감독관이 시행하고 있다. 이처럼 근로감독관과 선원근로감독관의 직무상의 목적은 다르지 않으나 직무 수행의 근거가 되는 법령이 상이하다 보니 각각 독립적으로 발전하였다. 이 논문에서는 근로감독관과 선원근로감독관 제도의 검토를 통해서 선원근로감독관제도의 법적 과제를 도출하고 이를 개선하기 위한 방안을 제시하고자 한다. 우선, 선원법은 시대적 변화에 따라 발전하여 왔지만 근로감독행정에 있어서 안전보건분야가 미흡하다. 선원법적으로도 안전보건에 대한 행정감독권이 명확하게 규정되어 있지 않다 보니 행정감독의 공백이 발생할 수 있으며 선원의 안전이 위협받을 수 있다. 따라서 선원법 개정을 통해서 선내안전보건에 관한 감독권을 명확하게 하고 정부의 안전보건집행을 강화할 필요성이 있다. 사업장의 안전보건감독은 근로감독관 직무의 하나로서 사법경찰권을 가지고 있는 선원근로감독관이 수행하는 것이 타당하다고 판단된다. 그러나 현실적으로 선원근로감독관은 안전보건 분야의 전문성이 결여되어 있고 과도한 업무량 등으로 인해서 추가적인 업무를 수행할 수 없다. 따라서 전문성을 제고하기 위한 교육과정을 개발하고 직무분석을 통해서 적정정원이 확보되어야 가능할 것으로 판단된다. 또한 해사노동협약의 해사노동인증검사 대행기관 소속 검사원이 현장의 근로조건, 생활조건 및 안전보건에 대한 검사를 수행하고 있으므로 이들에게 선원근로감독관 같은 권한과 함께 업무와 관련된 비밀 유지의 의무를 부과해야 할 것이다.

영문 초록

Labour supervision in workplaces is one of the state's actions to achieve social safety by practically implementing the justice of relevant labour laws and protecting the working conditions and safety and health of workers. Substantial performance of these national tasks is carried out through labour inspector under the Labour Standards Act, and seafarer’ labour inspector exist for workplace and seafarer subject to the Seafarers’ Act. As such, although the purpose of labor inspectors and seafarer' labour inspectors are the identical, the labour laws that serve as the basis for their duties are different, therefore, each has developed independently. In this paper, through a comparative study of the labour inspectorate system and the seafarer’ labour inspectorate system, the legal tasks of the seafarer labour inspectorate system are derived and the directions for the improvement are suggested. First of all, the Seafarers’ Act has been developed according to the times, but the safety and health field in labour supervision administration is insufficient. Even in the Seafarers’ Act, the administrative supervision authority for safety and health is not clearly stipulated. As a result, a vacuum in administrative supervision may occur and the safety of seafarers mighty be worsened. Therefore, it is necessary to clarify the supervisory authority for seafarers’ safety and health through the revision of the Seafarers’ Act and to strengthen the government's safety and health enforcement. As one of the duties of the labour inspector, it is considered appropriate for the safety and health supervision of the workplace to be performed by the seafarer' labour inspector who has judicial police authority. However, in reality, current seafarer' labour inspectors lack expertise in the field of safety and health and they can not perform additional tasks due to excessive workload. Therefore, it will be possible only when an appropriate number of the inspector and the experts are secured through the duty analysis and the development of a training course to enhance professional knowledge. In addition, since the inspectors belonging to recognized organization of the maritime labour inspection under the Maritime Labour Convention perform the inspections on working conditions, living conditions, and safety and health at the site on behalf of Flag State, they must be given the same authority as seafarer' labour supervisors and the duty to keep work-related confidentiality.
