태풍 피항 선박 안전관리를 위한 법제적 고찰

국문 초록

항해 중인 선박은 해양 기상의 악화에 큰 영향을 받으므로 적절하게 대비하여야 한다. 특히, 강력한 바람과 높은 파고를 동반하는 태풍은 선박에 치명적일 수밖에 없으며, 인명 손상과 재산상 피해, 해양오염을 유발하는 해양사고로까지 이어지기도 한다. 이러한 해양사고를 예방하기 위하여 태풍의 내습이 예보되면 선박은 안전한 해역을 선정하여 피항하여야 하며, 외부적으로 피항 중인 선박에 대한 안전관리가 이루어져야 한다. 그러나 해마다 다수의 태풍이 발생하고, 우리나라에도 영향을 미치고 있지만, 선박에 대한 피항지 지정과 안전관리가 원만하게 이루어지지 못하고 있다. 태풍이 내습할 때마다 많은 선박이 피항지 선정에 어려움을 겪고 있으며, 피항 중 충돌, 좌초 등 각종 사고가 발생하고 있다. 따라서 태풍 등 기상악화에 기인한 선박에 대하여 피항지를 제공하여 조난을 예방하고, 피항 중인 선박을 안전하게 관리할 수 있는 법제적 개선방안을 마련할 필요가 있다. 이 연구는 우리나라에 영향을 미치는 태풍의 현황과 태풍 및 기상악화에 의한 해양사고 사례분석을 통해 태풍 피항지 지정의 필요성을 검토한다. 그리고 유엔해양법협약을 비롯한 국제규범과 국내 법령을 살펴보고, 외국선박에 대한 연안국의 태풍 피항지 제공 의무가 존재하는지, 태풍 피항 관련 국내법의 실효성이 있는지를 검토하며, 태풍 피항지를 지정하여 운영함에 따라 발생할 수 있는 법적 쟁점에 대하여 고찰하고자 한다. 그리고 태풍 내습에 대비한 피항지 지정 및 피항 선박 안전관리 방안을 제시한다.

영문 초록

Vessels at seas are greatly affected by the deterioration of marine weather, so they must prepare appropriately. In particular, typhoons accompanied by strong winds and high waves are inevitably fatal to ships, and sometimes lead to marine accidents that cause human damage, property damage, and marine pollution. In order to prevent such marine accidents, when an attack by a typhoon is predicted, the vessel must select a safe sea area to evacuate, and external safety management must be performed for the vessel in evasion. However, a number of typhoons occur every year and although they affect Korea, the designation of safe areas for ships and safety managements are not being carried out smoothly. Whenever a typhoon strikes, many ships have difficulty in choosing a place of refuge, and various accidents such as collisions and groundings occur during the evacuation. Therefore, it is necessary to prepare a legal plan to prevent distress by providing shelter to ships caused by heavy weather such as typhoons, and to safely manage ships in evasion. This study examines the current status of typhoons affecting Korea, cases of marine accidents caused by typhoons and deteriorating weather, and the necessity of designating typhoon avoidance areas. In addition, international law including the United Nations Convention on the Law of the Sea and domestic laws are reviewed, and whether the coastal state has an obligation to provide a typhoon shelter to foreign ships, review whether domestic laws related to typhoon shelter are effective, and designate and operate a typhoon shelter. I would like to consider the legal issues that may arise. In addition, it presents a plan to designate a place of refuge in preparation for a typhoon and to manage the safety of a ship.
