개성공단 보험규정에 대한 법적 고찰

국문 초록

본 연구의 목적은 개성공업지구 등 남북경제협력지구에 적합한 보험규정을 모색하는 것이다. 이를 위하여 북한 헌법, 북한 보험법, 북한 개성공업지구법 중 보험과 관련되는 내용을 분석한 후 ‘개성공업지구 보험규정’의 모든 조문을 보험법 이론에 따라비판적으로 고찰하였다. 2004년 채택되었던 ‘개성공업지구 보험규정’은 1995년 채택된 이후 2015년 4월 5차 개정된 현행의 ‘조선민주주의인민공화국 보험법’에 비하여북한 보험법이론 수립 초기 단계의 낮은 완성도에 머물러 있다. 우선, 사회주의 특유의보험자의 우월적 지위를 인정하는 제23조 제3항과 제5항 등의 보험자의 보험계약 취소관련 규정은 시급하게 개정되어야 한다. 이들 조항은 사회주의 체제에서 사실상 독점적으로 보험사업을 경영하고 있는 ‘국가의 지도’를 따르지 않을 경우 보험자의 계약취소를 인정해 주고 있기 때문이다. ‘피보험자’라는 용어를 ‘보험계약자’로 변경할 필요가 있는 ‘개성공업지구 보험규정’은 제7조, 제8조, 제9조, 제10조, 제11조, 제12조, 제13조, 제14조 등이며 ‘피보험자’를 ‘보험계약자, 피보험자, 보험수익자 등’으로 정정을 검토할 수 있는 ‘개성공업지구 보험규정’은 제15조, 제16조, 제17조, 제19조, 제21 조, 제23조 등이다. 향후 남북한 보험법제 전반에 걸친 공통점과 차이점을 규명하는연구를 지속하면서 보험 분야 남북한 통일법제를 모색해야 한다.

영문 초록

All provisions of North Korea's 'Gaesong Industrial Zone Insurance Regulations' were critically reviewed according to the theory of insurance law. It was confirmed that there is a fundamental difference in the composition of insurance theory between North Korea's insurance law system, which is characterized by socialistic insurance, and South Korea's insurance law system based on liberal contracts. North Korea's insurance legislation is government-led, and the leading position of insurance companies is included in insurance regulations. This is a point of view that is in contrast to South Korea's insurance legislation that guarantees equal status. Recognizing these differences, mutual understanding, discussions, and negotiations between South and North Korean insurance experts are needed. This thesis is a basic study on the insurance legislation that can be applied by agreement between South and North Korea in the future inter-Korean economic cooperation zone through consideration of the 'Gaesong Industrial Zone Insurance Regulations'.
