현행 국회의원선거제도 개혁안

국문 초록

최근 국회 정치개혁특별위원회가 국회 전원위원회에 상정할 국회의원 선거법 개정안 3개를 의결했다. 개편안 세가지는 도농복합형 중대선거구제+권역별･병립형 비례제, 개방명부식 대선거구제+전국･병립형 비례제, 소선거구제+권역별･준연동형 비례제이다. 그런데 이 3가지 안은 이번 선거법 개정의 목표, 즉 표의 등가성과 비례성 및 사표방지를 내용으로 하는 평등선거의 원칙, 정치적 다양성과 소수보호를 지향하는 다원적 민주주의의 및 정당민주주의의 강화라는 목표를 제대로 실현하기 어렵다. 권역별 비례대표제, 병립형 비례대표제, 준연동형 비례대표제, 중대선거구제 모두가 헌법이론상 문제가 있다는 것이다. 그 대안으로 소선거구 다수대표제와 연동형 비례대표제가 결합된 선거제도를 제안한다. 아울러 전체 의원정수의 확대, 비례대표의석 비율의 증대, 전국구 비례대표제, 상향식 공천제도를 포함하는 정당내부의 민주화와 그 법정화, 비례대표선거의 경우 개방형 정당명부제가 아닌 고정형 정당명부제의 채택, 봉쇄조항기준의 하향화, 지역구선거와 비례대표선거의 중복입후보의 허용, 당내경선의 경우 국민참여경선제가 아닌 폐쇄형 경선제의 채택, 의무투표제의 도입 등 다양한 제도적 보완도 이루어져야 한다. 이럴 때 비로소 진정한 다원적 정당민주주의가 실현되고, 국민들의 다양한 정치적 견해가 국정에 효율적으로 반영될 수 있을 것이다.

영문 초록

The Special Committee on Political Reform of National Assembly recently resolved three reformation proposals for election system of member of the National Assembly which will be submitted to the Committee of the Whole. Those proposals are the Multimembered Constituency + Regional･Mixed-member Majoritarian Representation System, the Multimembered Constituency System + National･Mixed-member Majoritarian Representation System, and the Single-member Constituency + Regional･Quasi Mixed- member Propotional Representation System. However, the Proposals cannot realize the basic principles of the election and the spirit of the Constitution, for exemple the principle of equal election, party democracy, plural democracy, a multiparty system, protection of minority, etc. Therefore, the mixed-member propotional representation system combined with single-member Constituency should be adopted for the effective reform of election system. The constituency of propotional representation system should be nationwide. Futhermore, the number of the National Assembly members should be increased to vitalize the diverse functions of the National Assembly. At the same time, the rate of the proportional representative National Assembly members must be expanded. Also, some important institutional conditions regarding the election should be adopted as follows: the democratization and legalization of candidate nomination process of the party, the closed and fixed list system, closed primary election system, mandatory voting system, etc.
