‘관련’(relevant) 국제표준의 관련성에 대한 소고

국문 초록

WTO 회원국들은 국제표준이 존재하는 경우 국제적인 조화를 위하여 국내 기술규정을 만드는 경우 국제표준을 기초하여 제정한다. TBT 협정 제2.4조는 국제표준의 정의 문제와 국제표준이 존재하는가라는 문제로 귀결되었으며, 따라서 TBT 협정과 관련된 사건에서 국제표준에 대한 논의는 매우 중요한 이슈라고 할 수 있다. 그러나 국제표준에 대한 논의에서 ‘관련’(relevent) 국제표준이 무엇인지 그 관련성에 대한 논의는많은 주목을 받지 못하였다. EC—Sardines 사건은 ‘관련’ 국제표준의 관련성에 대하여 ‘관련’(relevant)이라는용어의 통상적 의미에 비추어 분석하였다. ‘관련’이라는 용어의 통상적 의미는 ‘당면문제와 관련있는 또는 관계있는: 적절한’이며, 용어의 통상적 의미에 따른 해석을 통해관련 국제표준임을 인정하였다. EC—Sardines 사건의 ‘관련’이라는 용어의 통상적 의미에 따라, US—Tuna II (Mexico) 사건 패널은 관련 정의 및 인증이 ‘관련 국제표준’을 구성한다고 판단하였지만, US—Tuna II (Mexico) 사건 상소기구는 국제표준에 해당성을 부정하여 ‘관련’이라는 용어의 의미를 판단하지 않았다. ‘관련성’이라는 표현은 ‘관련’ 국제표준의 관련성 이외에도 ‘국제표준에 관한 TBT위원회 결정’에도 등장한다. 동일한 표현을 사용하고 있지만, 6가지 원칙에서 등장하는‘관련성 원칙’에서의 관련성은 불필요한 국제표준이 개발되는 것을 방지하는 역할을 한다고 볼 수 있는 반면, ‘관련’ 국제표준의 관련성은 국내 기술규정이 이렇게 개발된 국제표준과 조화되도록 하는 역할을 하고 있다고 할 수 있다. 이 두가지 관련성은 문언적으로 서로 구별할 필요성이 있으며, 연혁적으로도 구분되는 개념으로서 구별할 필요가 있을 것이다. TBT 협정의 국제표준은 국제적인 조화를 도모하기 위한 장치이다. 그러나 조화의무는 단순히 국제표준에 기초하는 것이 아니라 ‘관련 국제표준’에 기초해야 할 것이다.

영문 초록

When international standards exist, WTO members need to make domestic technical regulations based on international standards for international harmonization. Article 2.4 of the TBT Agreement is related with the issue of the definition of international standards and whether international standards exist or not. However, in the discussion of international standards, the discussion has been only focused on international standard itself and ‘relevant’ international standard has not received that much attention. The EC—Sardines was analyzed in light of the ordinary meaning of the term ‘relevant’ as to the relevance of ‘relevant’ international standards. The ordinary meaning of the term ‘relevant’ is ‘bearing upon or relating to the matter in hand; pertinent’, and in EC— Sardines it was recognized as a relevant international standard through interpretation in accordance with the ordinary meaning of the term. Using the analysis in EC—Sardines, the US—Tuna II (Mexico) panel held that the related definitions and certifications constituted a ‘relevant international standard’ under Article 2.4 of the TBT Agreement. However, US—Tuna II (Mexico) appellate body did not analyze the meaning of the term, as it did not fall under the international standard. In addition to the relevance of ‘relevant’ international standards, the expression ‘relevance’ also appears in the six principles of the ‘TBT Committee Decision on International Standards’. Although the same expression is used, the relevance in the ‘relevance principle’ that appears in the six principles can be seen as playing a role in preventing unnecessary international standards from being developed. The relevance of ‘relevant’ international standards can be said to play a role in harmonizing domestic technical regulations with the international standards thus developed. These two ‘relevance’ need to be distinguished from each other linguistically and historically as distinct concepts. The international standard of the TBT Agreement is a device to promote international harmony. However, the obligation to harmonize should not simply be based on international standards, but on ‘relevant’ international standards.
