양육비이행관리원 체계의 문제점과 개선방안

국문 초록

양육비의 이행강화에 관한 논의는 2004년에 시작되었다. 당시 급격하게 증가한 이혼에 따라 미성년 자녀를 양육하게 된 한부모도 증가하였기 때문이다. 초기에는 민법을 개정하여 협의이혼에 있어서 양육비에 관한 합의를 필수적인 절차로 함으로써 이혼한 부부 사이에서 양육비의 부담에 관한 합의가 이루어지게 하였다. 그렇지만 그것만으로는 이행강제를 위한 준비가 충분하지 않다는 점에서 이혼사건을 담당하는 가정법원이 양육비채무자의 양육비 부담에 대한 조서를 작성하도록 함으로써 양육자가 곧바로 강제집행을 할 수 있도록 하였다. 그러나 법률전문가가 아닌 양육자가 스스로 강제집행절차를 진행하는 것이 힘들다는 점을 고려하여 양육비의 이행을 강제할 수 있는기관을 설립하게 되었는데, 이는 2005년 여성가족부에서 양육비이행기관에 대한 논의를 시작한지 10년만에 입법적인 결실을 보게 된 것이다. 그렇지만 양육비이행관리원을 한국건강가정진흥원이라는 기관의 내부에 둠으로써 독립된 기관으로서의 지위를 확보하지 못한 상태가 되었고, 그 결과 양육비이행관리원이 독자적인 업무수행과 소송의진행을 할 수 없게 되어 양육비의 이행강제가 지연되는 문제를 야기하였다. 외국의 경우에는 양육비이행기관이 모두 국가기관이거나 행정기관이고, 독립된 기관이며, 이행강제업무를 원활하게 수행하기 위하여 비양육친의 주소나 재산을 파악할 수 있는 권한을 가지고 있다. 그렇지만 우리의 양육비이행관리원은 공공기관의 일개 부서로서의 지위만 확보하고 있을 뿐이다. 또한 양육비이행관리원을 관리하는 한국건강가정진흥원의 업무와 양육비이행관리원의 업무가 서로 다르기 때문에 양육비이행강제라는 업무수행을 위하여 유기적으로 결합하는 것도 어려운 상황이다. 나아가 최근에 논의되고 있는양육비의 대지급이 이루어지기 위해서는 양육비이행관리원이 양육비의 지급과 구상에관한 업무를 감당할 수 있는 적절한 권한을 가져야 한다.

영문 초록

Discussions on strengthening the performance of child support began in 2004. This is because the number of single parents who raised minors increased according to the rapid increase of divorce rate at that time. Initially, the Civil Act was amended to make an agreement on child support expenses as an essential procedure in a divorce by agreement, so that an agreement on the burden of child support was reached between divorced couples. However, given that it was not enough to prepare for compulsion of performance, the court can draw up a report on the burden of child support so that it could be enforced immediately. However, considering that it is difficult for single parents to carry out compulsory execution proceedings on their own, an institution was established that could force the implementation of child support. This is a legislative result about the institution of child support performance that was finally made after a decade of discussion in the Ministry of Gender Equality and Family since 2005. However, by placing the Child Support Agency under the Korean Institute for Healthy Family, it has not been able to secure its status as an independent institution. Therefore, as it became difficult for the Child Support Agency to conduct its own duties and proceed with the lawsuit, it caused a problem of delaying the compulsory performance of chil support. In foreign countries, all child support performance institutions are state agencies or administrative agencies, independent institutions, and have the authority to identify the address or property of the child support debtor. However, our Child Support Agency only secures its status as a public institution. In addition, since the work of the Korean Institute for Healthy Family and Child Support Agency are different, it is difficult to organically combine them to perform the work of compulsory child support. Furthermore, in order to accomplish a result regarding instead payment of child support, which is under discussion recently, the Child Support Agency must have appropriate authority to handle the work. The independence and authority of the Child Support Agency should be strengthened as soon as possible.
