초·중등교육법상 생활지도에 대한 법적 성격과 과제

국문 초록

지난 2022년 12월 8일, 교원의 생활지도 권한 강화를 골자로 한 초중등교육법 일부 개정안이 국회를 통과하였고, 2023년도 6월 28일 시행을 앞두고 있다. 법 개정 이전 초·중등교육법 제18조에서는 학생징계 이 외에도 ‘그 밖의 방법으로 학생을 지도할 수 있다’라는 내용이 법문언에 포함되어 있었고, 제18조에서 의미하는 ‘그 밖의 방법’이 무엇인가에 대한 해석론상 여지를 남기고 있었다. 그러나, 이번 법 개정으로 초중등교육법 제18조의 '그 밖의 방법'에 대한 내용이 삭제되었고, 제20조의 2에서 학생생활지도로 명확하게 규정되면서 교원에게 실질적인 학생생활지도 권한이 부여되었다. 학생생활지도와 관련하여 향후 제기될 수 있는 법적 쟁점과 과제와 관련하여 본 연구에서 주목하는 사항은 다음과 같다. 첫째, 이번에 신설된 초중등교육법 제20조의 2에서도 ‘교원의 교육활동을 위하여 필요한 경우’라는 불확정법개념이 제시되어 있고 학생지도에 대한 개별적·구체적인 근거는 ‘법령과 학칙으로 정하는 바’에 따라 지도할 수 있는 것으로 규정되어 있는 바, 학생 생활지도에 대한 법적 성격을 검토하였다. 둘째, 법령과 함께 학칙으로 학생생활지도에 대한 내용을 정하도록 하고 있는 바, 학생생활지도의 구체적인 수단과 방법 등을 학칙으로 정하는 경우, 학칙 제·개정에 앞서 검토되어야 할 사항이 무엇인가에 대하여 검토하였다. 요컨대, 본 연구는 초중등교육법 제20조의 2 학생생활지도 신설에 따라 향후 제기될 수 있는 과제를 검토하고 향후 개선이 필요한 사항에 대하여 제안하고 있다.

영문 초록

On December 8, 2022, some amendments to the Elementary and Secondary Education Act, which aims to strengthen teachers' authority to guide student’s school life, passed the National Assembly(South Korea), and are set to take effect on June 28, 2023. In Article 18 of the Elementary and Secondary Education Act before the revision of the law, in addition to student guidance regulation, the text of the law included “other methods can be guided” and left an issues for interpretation of what “other methods” meant in Article 18. However, due to the revision of the law, the contents of Article 18 of the Elementary and Secondary Education Act were deleted, and Article 20-2 clearly stipulated as student guidance, enabling practical student guidance for teachers. The following are the matters to be noted in this study regarding legal issues and tasks that may be raised in the future in relation to student guidance. First, Article 20-2 of the newly established Elementary and Secondary Education Act also provides an indeterminate legal concept(‘unbestimmter Rechtsbegriff’ in German) of 'when necessary for educational activities of teachers', and individual and specific grounds for student guidance can be guided in accordance with 'national laws and school regulation'. Second, the contents(especially, teacher’s guidance method) of student guidance are required to be determined by school regulations, and in the case where specific means and methods of student guidance are determined by school regulations, what matters should be reviewed before enacting or revising school regulations were reviewed. In short, this study reviews legal issues and tasks that may be raised in the future due to the establishment of new student guidance in Article 20-2 of the Elementary and Secondary Education Act and proposes matters that need to be improved in the future.
