국문 초록

지방자치의 개념은 불변의 개념이 아니라 시대가 변함으로써 같이 변할 수밖에 없으며, 특히 지금과 같이 예측이 불가능하고 신속한 행정이 미덕으로 간주되는 시대에 지방자치의 가치와 본질이 이전과 똑같을 수는 없다. 변화하는 상황에서 지방자치는 민주주의적 관점에서 그 존재의 의의를 찾을 수 있다. 재정분권은 실질적 지방자치 실현을 위한 수단이자 전제조건이지 그 자체로 목적이 되어서는 안 된다. 재정분권의 기준과 완성도에 대한 평가는 지방이 스스로의 책임으로 자치사무를 수행하는데 필요한 재정력이 뒷받침되는지를 기준으로 살펴보아야 할 것이다.무턱대고 지방의 재원을 늘려주거나 전국 모든 지역에 일률적으로 재원을 늘려주는 것은 큰 의미가 없다. 지방자치단체가 자치사무를 수행하는 데 필요한 재원의 적절한 배분이 기초가 되어야 하고, 국가나 시․도의 사무를 수행하는 경우 그 위임사무 수행 경비를 적절히 이전하면 된다. 따라서 우선 지역의 실정에 대한 검토가 이루어져야 하고, 지역의 지리적․사회적 환경을 고려하여 자치사무 수행에 필요한 재원이 충분히 배분되어 있는지를 검토하여야 한다. 마지막으로 국가 등의 위임사무를 수행하는데 그 경비 부담이 적절히 이루어지는지를 검토하여야 할 것이다.

영문 초록

The concept of local autonomy is not an immutable concept, but is bound to change as times change, and the value and nature of local autonomy cannot be the same as before, especially in an era where rapid administration is considered a virtue in an unpredictable era. In the changing situation, local autonomy can find the significance of its existence from a democratic perspective. Fiscal decentralization is a means and prerequisite for realizing actual local autonomy, and should not be an end in itself. The evaluation of the criteria and completeness of fiscal decentralization should be examined based on whether the financial power necessary for local governments to perform autonomous affairs on their own responsibilities. It is not very meaningful to increase the financial resources of local governments or to increase the financial resources uniformly in all parts of the country. The appropriate allocation of financial resources necessary for local governments to perform local affairs should be the basis, and when performing affairs of the state, city, or province, the expenses for performing delegated affairs should be appropriately transferred. Therefore, first of all, a review of the actual conditions of the region should be conducted, and it should be reviewed whether the financial resources necessary for the performance of autonomous affairs are sufficiently distributed in consideration of the geographical and social environment of the region. Finally, it is necessary to examine whether the burden of expenses is appropriately carried out in performing delegated affairs such as the state.
