군형법의 문제점과 개정방향에 대한 고찰

국문 초록

군형법은 형법의 특별법으로서 군의 조직과 질서를 침해하는 행위를 범죄로 규정하고 이에 대한 형벌을 규정하고 있다. 군형법은 1962년 제정된 이래 19차례 개정과정을 거쳐 오늘에 이르고 있다. 그동안 개정과정을 통해 사회민주화와 군의 발전추세에 따라 법정형을 합리적으로 조정하는 등 군인의 인권보장을 강화하고 군형법을 개선하여 왔다. 그러나 군형법의 개정과정을 보면 군형법 기본체계는 유지한 가운데 군형법의 적용범위나 법정형 조정, 위헌법률 조항과 타법률 개정에 따른 일부개정 등 부분 개정에 국한되어 근본적인 개선에는 미치지 못하고 있다. 군형법의 주요 문제점은 죄형법정주의 위반 논란, 형법과 중복된 규정, 무거운 법정형, 사문화된 규정 등이다. 최근 군 인권의식 향상과 대법원 판례 등에서 시대적 변화가 나타나고 있다. 이에 군형법도 지금까지 제기되었던 문제점을 개선하고 장병들의 인권을 보장하고 시대변화에 맞도록 합리적인 개정이 필요하다. 본고에서는 군형법의 개정방향으로 ① 사회문화 변화 및 죄형법정주의를 고려한규정 정비(추행죄, 명령위반죄, 군용물관련 처벌조항, 보충적이적죄), ② 일반형법(특별법 포함)으로 처벌 가능한 부분은 제외하여 형법과 중복성을 최소화 하여 순정군사범 위주로 개편, ③ 과도한 법정형 개선(사형관련 조항 등), ④ 기타 사문화된규정과 불필요한 조항 개정(상관제지불복종죄, 부하범죄부진정죄, 특수군무이탈죄)에 중점을 두고 관련된 문제점을 검토하고 바람직한 개정방안을 제시하고자한다.

영문 초록

The Korean Military Criminal Law(hereinafter as KMCL) defines the act of infringing on the organization and order of the military as a special law of criminal law and defines the punishment for this. The KMCL has reached today after the revision process 19 times since it was enacted in 1962. Through the revised process, we have been strengthening the guarantee of human rights and trying to transform into KMCL by rationally adjusting the punishment according to the trend of social democratization and the development of the military. However, under the revision process of the KMCL, the basic system of the KMCL is maintained, and it is limited to partial improvements such as the scope of application of KMCL adjustmnet, the punishment adjustment, partial amendment of KMCL, in accordance with the amendment amendment of the constitutional law and other laws’s revision of partial revision. The major problems of the KMCL are the controversy over violation of the the principle of legality, the regulation that overlaps with criminal law, heavy legal punishment, practically ineffective regulations. Recently, changes in the consciousness of the military human rights and the case of the Supreme Court are changing. The KMCL also needs to improve the problems raised so far, guarantee the human rights of soldiers and make reasonable revisions to suit the change of the times. In this paper, the revision direction of the KMCL is as follows. : firstly, revision of the KMCL, in consideration of the changes in social culture and the principle of legality. Secondly, Minimize duplication with Criminal Law(including Special Criminal Law) and revise with emphasis on a genuine military cime. Thirdly, revise heavy punishment. such as death penalty. Finally, revise practically ineffective regulations and unnecessary regulations.
