우리나라 임대차 정책의 개선방안 연구

국문 초록

본 연구의 목적은 우리나라 부동산 임대차 정책의 문제점을 검토하여 개선방안을 제시하는 것이다. 이러한 목적을 달성하기 위하여 지나온 우리나라 임대차 정책의 현황을 검토한 후 그 부작용으로 인한 문제점을 도출하였으며, 개선방안 마련을 위해 일본, 독일, 미국의 임대차 관련 정책을 검토하였다. 또한, 현실적인 개선방안을 제시하기 위해 임대차 정책의 수요자인 국민과 중개업자를 대상으로 인식도 설문조사를 수행하였다. 국내외 현황분석을 통한 국내 임대차 정책의 문제점으로는 어떤 규정된 표준 임대료지수나 지역별, 단지별 전세금 상한 기준 등의 근본 대책이 없이 미봉적으로 개정된 임대차 보호법은 임대인과 임차인 모두에게 큰 고통과 부작용만을 초래하였다. 그리고 정부는 임대차 정책을 수립, 집행하는데 있어서 사전 검토 및 사후평가 체계 부재의 문제를 노출하였다. 한편, 인식도 설문조사를 통한 현행 개정 임대차보호법의 개선방안은 임대료 안정을 위해서 지역별 물가지수를 반영한 ‘표준임대료지수제’ 도입, 깡통전세 등 전세금 보호를 위한 ‘전세금상한제 도입’ 운영과 임대인의 ‘이전차임 정보제공 의무’를 통한 임차인 보호 체계 마련, 정책 시행 전 사전공청회 실시와 사후 정책평가의 필요성에 대한 방안 등을 제시하였다. 임대차 정책은 다양한 이해관계자가 얽혀 있으며, 임대인과 임차인의 중립적인 위치를 유지하기가 매우 어려운 정책이다. 그러나 부동산 임대차 정책은 국민의 생활과 직결되는 것으로 높은 신뢰성과 시장을 고려하는 종합적인 판단력, 예측력이 매우 중요한 정책이라고 할 것이다.

영문 초록

The primary purpose of this study is to review the problems of Korea's real estate lease policy and present improvement measures. In order to achieve this purpose, after the current status of the lease policy in Korea was reviewed, problems caused by side effects, and lease-related policies in Japan, Germany, and the United States were also reviewed to come up with improvement measures. In addition, in order to present realistic improvement measures, a perception survey was conducted on the people and brokers who are consumers of Lease policies. As a problem with the domestic Lease policy through analysis of the current situation at home and abroad, the Revised Lease Protection Act, which was temporarily revised without fundamental measures such as any prescribed Standard rent index, region, or complex, caused only great pain and side effects for both landlords and tenants. In addition, the government exposed the problem of the absence of a preliminary review and follow-up evaluation system in establishing and implementing Lease policies. Meanwhile, the plan to improve the current Revised Lease Protection Act through an awareness survey was to introduce a “Standard rent index system” that reflects the price index by region to stabilize rents, to introduce and operate an Upper limit system to protect lease deposits, such as a can lease, to prepare a tenant protection system through the landlord's obligation to provide information on previous rent, and to Conduct public hearings before implementing policies and evaluate follow-up policies. Lease policy is a policy in which various stakeholders are intertwined and it is very difficult to maintain a neutral position between landlords and tenants. However, the Real estate lease policy is directly related to the lives of the people, and it can be said that high reliability, comprehensive judgment ability, and predictive ability are very important policies.
