국문 초록

구분지상권은 입체적 토지 이용의 증가로 도입된 제도이다. 구분지상권은 부동산등기 제도로 운영되고 있으며 구분지상권 제도 운영에 있어 나타나는 여러 가지 민원 사례를 분석하였다. 분석 결과 첫째, 구분지상권은 공공을 목적으로 설정하였다. 둘째, 구분지상권은 부동산등기의 분류상 사권에 해당하지만, 실체적 성격은 공적인 성격이 강하다. 셋째, 구분지상권 제도 운용에 있어 토지소유자와 국가는 상당한 의견 차이를 보이고 있다. 넷째, 국가가 공익을 목적으로 구분지상권을 설정할 경우 헌법재판소는 이에 대한 타당성을 인정하였다. 구분지상권은 토지의 지하･지상의 특정 공간에 입체적 범위를 구분하여 설정하는 지상권의 일종으로 토목･건축 기술의 발달로 토지 이용의 효율화를 도모하고자 1984년 민법 개정으로 도입된 권리이다. 향후 구분지상권 설정이 확대되길 기대해 본다.

영문 초록

The divided land area is a system that introduced due to increasing in the three-dimensional use of land. The divided land area is operated by the real estate registration system, and various civil’s complaint that appeared in the operation of the divided land area system were analyzed. As a result of this analysis, first, the divided land area was established for public purposes. Second, the classified superficies correspond to private rights in the classification of real estate registration, but the substantive nature is strong in public character. Third, landowners and the country have significant differences in their opinions in the operation of the divided land area system. Fourth, when the state conducts divided superficies for the public interest, the Constitutional Court recognized the validity of this project. The divided land right is a type of land right that is set by dividing the three-dimensional scope of a specific space on the underground and ground of land, and was introduced in 1984 by the revision of the Civil Act to promote efficiency of land use with the development of civil and building technology. We look forward to expanding the establishment of divided land rights in the future.
