국문 초록

이 글은 2019년 헌법재판소의 낙태죄 헌법불합치결정으로 임신중지 비범죄화가 된 이후, 한국에서 임신중지 보건의료체계 구축을 위한 방향 모색을 목적으로 한다. 이를 위해 최근 임신중지 합법화 및 제도화가 이루어진 아르헨티나와 아일랜드의 사례를 재생산 건강권의 맥락에서 살펴본다. 아르헨티나는 2020년, 아일랜드의 경우 2019년에 각 국가의 임신중지법이 통과되며 임신중지가합법화되었다. 이 글에서는 각 국가의 재생산권 운동 속에서 여성의 임신중지가 자기결정권 대 태아의 생명권이라는 프레임으로부터 재생산 건강권의 문제로 담론의 초점이 변화해 온 배경을 살펴보고, 아르헨티나와 아일랜드에서 안전하고 합법적인 임신중지를 확대할 수 있는 보건의료체계가 어떠한 방식으로 갖추어졌는지 분석한다. 임신중지를 엄격하게 금지해온 아르헨티나와 아일랜드에서임신중지가 공공의료서비스로 확립된 사례는 한국에서 임신중지 의료서비스에 대한 실질적 접근성을 확대하는 방안과 의료서비스 제도화 방향에 중요한 시사점을 준다.

영문 초록

The purpose of this article is to find measures for establishing abortion care system in South Korea. Although Abortion was decriminalized in 2019 by the Constitutional Court’s decision in South Korea, healthcare system has not yet been mandated that people who are in need of abortion care are still facing problems due to lack of information and privatization. In this context, the cases of Argentina and Ireland, where abortion was recently legalized and institutionalized, will be reviewed with the perspective of right to reproductive health. In Argentina, ‘Access to Voluntary Termination of Pregnancy(Law No. 27,610)’ was passed and Article 86 of the Penal Code was amended in 2020 that abortion up to 14 weeks became legal. In Ireland, ‘Health (Regulation of Termination of Pregnancy) Act(2018)’ was passed in 2019, and abortion up to 12 weeks was legalized. This article examines the background of the shift in discourse on abortion from the frame of ‘pro-choice vs. pro-life’ to the issue of right to reproductive health. It also investigates how Argentina and Ireland equipped existing healthcare system for safe and legal abortion care. In-depth analysis on the healthcare system for abortion care in Argentina and Ireland, both in which abortion has been strictly prohibited, would suggest ways to expand effective access to and institutionalization of healthcare system for abortion care in South Korea.
