복지레짐과 범죄 그리고 사회통합: 미국과 스웨덴과의 비교를 중심으로

국문 초록

범죄와 사회불평등에 대한 대부분의 연구는 사회적 환경과 맥락 효과를 고려하고 있다. 복지레짐은 특정한 프로그램 및 정책은 물론 특정한 사회적 가치들을 공유한다. 복지주의적 관점에서, 범죄는 사회적 인과관계를 가진 사회적 문제이고 사회적 수단으로서 해결돼야 하는 문제이다. 이러한 관점에서, 복지레짐이 가지는 높은 수준의 복지 평등과 사회경제적 안전망, 그리고보편적 복지의 제공과 보장은 보다 회복적 행형과 범죄정책으로 연결된다. 결과적으로, 사회적 맥락과 복지레짐에 따라 행형정책은 서로 다른 모습을보이게 된다. 미국은 경제협력개발기구(OECD) 30개 주요 선진국 중 최고의 범죄율을보여주고 있다. 교정을 통해 범죄자들이 사회에 적응할 수 있도록 돕는 사회제도가 미흡한 미국에서 출소자들은 출소 후 노동시장에서 불안전한 고용과저임금, 그리고 가족의 해체 등을 경험하고 있다. 반면, 스웨덴은 낮은 범죄율, 수감률, 재범률이라는 전통을 지니고 있으며, 행형제도와 제재로 인한낙인이 거의 존재하지 않는다. 보편적 복지의 제공을 특징으로 하는 사민주의복지레짐의 역사적 제도와 문화를 가지고 있는 스웨덴은 낮은 범죄율과 수감률로 대표되는 스웨덴 행형예외주의(penal exceptionalism)를 보여준다. 본 논문은 두 나라의 차이를 설명하기 위해 복지레짐이라는 개념을 주목하였고, 형사사법제도와 행형시스템 그리고 사회통합 전략에서 나타나는 복지레짐의 제도적 상보성에 주목하였다. 본 논문은 자유주의 복지레짐과 사회민주주의 복지레짐에 해당하는 대표적 국가인 미국과 스웨덴의 비교를 통해 복지레짐에 따른 범죄통제 정책과 제도의 차이를 고찰하였고, 복지레짐별 범죄와그에 대한 사회적 대응 그리고 사회적 함의가 무엇인지를 살펴보았다. 이를통해서 범죄에 대한 가장 올바른 대책은 사후약방문보다는 예방이 우선이며, 범죄가 일어났을 경우에는 충분한 교정을 통해 범죄자들이 최대한 사회에적응할 수 있도록 돕는 사회제도를 마련하는 것이라는 점을 주장하였다. 가혹한 처벌만이 능사가 아니며, 최선의 범죄예방책은 보편적 사회안전망의구축과 회복적 사회통합 전략을 제도화하는 것임을 강조하였다.

영문 초록

Most studies of crime and social inequality consider social environment and social contexts. The welfare regime shares certain social values as well as specific programs and policies. From this, crime is a social problem and a problem to be solved through a social intervention. In this respect, the high level of equality, the socio-economic safety net, and the provision of universal welfare lead to more restorative and reintegrative punishments and crime control policies. As a result, depending on the social context and welfare regime, the crime control policy and social integration policy have a different appearance. The United States has the highest crime rate among 30 major developed countries in the Organization for Economic Cooperation and Development (OECD). In the United States, where there is a lack of a social system to help criminals re-enter to society, ex-convicts are experiencing unstable employment, low wages in the labor market and family disintegration. Sweden, on the other hand, has a tradition of low crime rate, incarceration and recidivism rate, and there is little stigma. Sweden, with its historical institutions and culture, shows Swedish penal exceptionalism, represented by low crime rates and imprisonment rates. In order to explain the difference between the two countries, this paper focused on the concept of welfare regime, and focused on the institutional reciprocity of welfare regime in the criminal justice system, correctional system, and social integration strategy. This paper examined the differences in crime control policies and institutions according to welfare regimes by comparing the United States and Sweden, the representative countries of liberal welfare regimes and social democratic welfare regimes. And also, this paper reviewed what the implications are. Through this, it was argued that the most effective counter-measures against the problems of crime are prevention rather than severe punishments. And in the event of a crime, it is necessary to provide a social system that helps criminals reintegrate into society. It emphasized that harsh punishment is not the only solution, and the best way to prevent crime is to establish a universal social safety net and institutionalize a resilient social integration strategy.
