인터넷 기술 정책의 공론화 모색

국문 초록

2020년 12월 정부는 망중립성 가이드라인 개정을 발표했다. 이 연구는 2017년부터 망중립성에 대한 국제환경의 변화와 5G의 상용화라는 기술 변화로 제기되었던 망중립성 정책의 수정을 위해 3년간 있었던 정부의 공론화 시도를 연구 대상으로 한다. 본 연구는 5G 시대 인터넷의 중요한 규범으로서의 망중립성이 어떤 공론화 과정을 거쳐 소통되어 정책이 결정되었는지 그 과정의 숙의성과 타당성을 탐색한다. 방법론적으로 망중립성의 정책 소통을 공론화 과정과 공론화 내용으로 나눈다. 우선 정책 과정의 숙의성을 평가하기 위해 협의체 구성 과정, 회의 과정 그리고 결과 도출 및 피드백 과정을 관찰하고, 다음 단계로 5G 기술과 망중립성의 관계에 대한 의사소통적 타당성을 평가한다. 동원된 자료는 방송통신위원회와 과학기술정보통신부의 2018- 2020년에 있었던 ‘인터넷상생발전협의회’와 ‘5G통신정책협의회’의 활동과 관련된 문헌자료와 두 협의체에서 활동하였던 시민단체 대표들과의 인터뷰 내용이다. 연구 결과, 두 협의체의 공론화 과정은 부분적인 숙의적 소통 양식을 채택하였으나 공론화의 조건인 포용성, 공개성, 자율성 및 충분성이 부족했다. 공론화 내용 측면에서 5G로 대표되는 네트워크 슬라이싱은 변할 수 없는 기술적 특성을 가진 것이 아니라 하나의 비즈니스 모델로서 그 자체가 망중립성과 대립하는 것은 아니라는 사실을 밝혔다. 또한 망중립성 논쟁은 망 이용료 및 제로레이팅과 관련된 부수적 이해 관계를 숨기고 있는 주제이며, 여기서 소비자 및 시민에게 망중립성이 어떤 영향을 미치는가 파악하는 것이 사회적으로 망중립성이 여전히 필요한가에 대한 정당성을 부여해 줄 것이다. 따라서 향후 5G 서비스의 개발 과정에서 나타날 수 있는 여러 문제, 즉 특수서비스의 구체적인 정의, 분류 및 허용 한계 그리고 경제적 인센티브의 배분 방식 등을 논의하기 위해 시민사회가 주도하고 정부가 지원하는 새로운 공론화 과정이 필요하다.

영문 초록

The Korean government announced a revision to the net neutrality guidelines in December 2020. This study aims to examine the government’s three-year public debate attempt to revise the network neutrality policy, which has been raised by changes in the international environment for network neutrality and technology changes such as commercialization of 5G since 2017. The research explores the political deliberation and communicative validity of the process. First, the public debate is observed in three phases; forming a consultative body, debate methods and result derivation end feedback process. The next step is to evaluate the communication validity of the discourse on the relationship between 5G technology and network neutrality. We use mainly public documents related to the activities of the ‘Internet Win-Win Development Council’ organized by Korean Communications Commissions and ‘5G Telecommunication Policy Council’ of the Ministry of Science and ICT, held two of all between 2018 and 2020. We also conducted interviews with representatives of civic groups who worked in the two consultative bodies. As a result, the public discussion process of the two councils adopted a partial deliberative communication style, but the conditions of public debate were insufficient in inclusion, openness, autonomy, and sufficiency. In terms of public debate discourse, the debate over the relationship between 5G and network neutrality revealed that objectively, network slicing represented by 5G is not incompatible with the net neutrality concept. This is because it itself is more of a business model than an irreplaceable technical characteristic. In addition, the network neutrality debate is a topic that hides incidental interests related to network usage fees and zero-rating, where identifying how network neutrality affects consumers and citizens will give justification for whether network neutrality is still necessary. Therefore, a new public debate process led by civil society and supported by the government is needed to discuss various problems that may arise in the process of developing 5G services in the future, such as ‘specialized services’ definitions and classification, and distribution of economic incentives.
