국문 초록

최근 반복적 양상을 보이는 대통령 탄핵의 특징과 민주주의에 대한 양가적 함의를 도출하고자 한다. 일반적으로 탄핵제도는 합리적이며 정당한 제도로 대통령(행정부)의 권력을 견제하는 수단으로 인식된다. 그러나 탄핵의 동기와 목적이 왜곡될 때, 대통령 탄핵은 민주주의와 정치적 안정에 부정적 영향을 미칠 수 있다. 본 연구에서는 페루의 사례를 통해, 탄핵제도가 어떤 조건에서 민주주의에 양가적 영향을 미칠 수 있는지에 주목했다. 이를 위해 Ⅱ장에서는 일반적인 탄핵 원인 및 가능한 조건에 대한 선행연구와 함께 페루 대통령 탄핵의 법적 토대를 검토했다. Ⅲ장에서는 지금까지의 페루 대통령 탄핵 사례들에서 나타난 탄핵의 원인과 조건을 분석했다. Ⅳ장에서는 비스카라 대통령 탄핵에서 나타난 특징과 정치적 영향을 살펴보았다. 결론에서는 페루 대통령 탄핵에서 나타난 최근의 반복적 양상을 극복하고 민주적 제도로써 본래의 기능을 할 수 있기 위해 필요한 과제를 제시했다. 페루 사례 특히, 비스카라 대통령에 대한 의회의 탄핵 시도 및 성공이 보여주는 것은 동기와 절차가 왜곡되었을 때 대통령 탄핵이 어떻게 민주주의를 교란시키며 정치불안정을 확산시키는가에 대한 것이다. 대통령-의회 간 대립의 극단적이면서도 정치화된 수단으로 탄핵이 반복적으로 동원될 때, 정치에 대한 국민들의 불신은 심화되며 선거가 갖는 정당한 대표성은 훼손한다. 이와 같은 대통령 탄핵의 문제를 해결하기 위해서는 먼저 헌법에 규정된 탄핵 사유를 보다 명확하게 하는 것이 필요하다. 또한 개인화되고 부패에 취약한 정당에 대한 개혁과 함께 여소야대의 상황에서 의회와 대통령 간 갈등 관계를 조정할 수 있는 제도적 장치를 마련해야 한다.

영문 초록

This study attempted to derive the characteristics of the recent repetitive pattern of presidential impeachment and ambivalent implications for democracy by examining the main causes and conditions in Peru s presidential impeachment cases. In general, the presidential impeachment is a rational and just means, and it is recognized as a means to check the power of the president. However, when the motive and purpose of impeachment are distorted, the presidential impeachment can have a negative impact on democracy and political stability. In this study, through the case of Peru, I focused on how the presidential impeachment could have an ambivalent effect on democracy under what conditions. To this end, in Chapter II, I reviewed the legal basis for impeachment of the Peruvian president and the previous studies on the factors and the political conditions for impeachment. In Chapter III, I analyzed the factors and conditions for impeachment in each case by examining the Peruvian cases. Chapter IV examined the characteristics and the political effect of the recent impeachment of the peruvian president. In conclusion, the task necessary to overcome the recent repetitive patterns of the presidential impeachment was presented. The impeachment of President Vizcara shows how the impeachment of the president disrupts democracy and spreads political instability when motives and procedures are distorted. In order to solve this problem of Peru’s presidential impeachment, the 1993 Constitution should be amended to more clearly stipulate the grounds for impeachment. And reform of personalized and corrupt parties are needed. Iinstitutional arrangements should be made to mediate the conflicting relationship between the parliament and the president.
