국문 초록

최근 회자되는메타버스는추상적가상공간인 사이버스페이스보다구체적으로조성된일정한 공간을 가리킨다. 메타버스에는 유저를 대신하는 아바타들이 각종 상거래, 쇼핑, 부동산거래, 강연, 여가활동 등 대부분의 활동을 실제처럼 할 수 있다. 이러한 메타버스의 사용이늘고이용이확산되어메타버스의세상이크게눈앞에펼쳐질것으로기대된다. 사실가상공간에서의대화는여러가지형식으로이미가능한상태지만메타버스라는용어로새롭게 전개되다 보니 메타버스에서의 여러 행위에 대한 법적 평가가 필요한 상황이다. 이에 따라 메타버스에서 이루어지는 상거래의 법적 절차나 그 유효성은 어떻게 봐야 하고, 메타버스에서 불의의 성폭력 사태가 발생하는 경우 형사책임은 어떻게 규정되어야 하며, 아울러 메타버스에서발생하는각종 창작물과표현물, 즉 콘텐츠나아이콘에대한 지식재산권은 어떻게 인정되고 규정되어야 하는지, 나아가 최근 급격히 발전하고 있는 인공지능이메타버스의아바타에적용될경우인공지능의법적문제는어떻게평가되어야하는지등 다양한 법률이슈가 등장하고 있다. 메타버스 세상은 놀랍게 진화하고 있다. 메타버스의 활용범위는 게임을 넘어, 생활, 소통, 업무 등 생활전반으로 확산되어 영향을 미칠 전망이다. 아울러, 메타버스 서비스가 확산되면서 디지털 휴먼의 활용이 증가하고 있는데, 엔터테인먼트, 유통, 교육, 금융, 방송 등 전산업으로그이용이확장될전망이다. 이에따라앞으로닥쳐올놀라운미래를대비한메타버스 전환전략이 요구된다. 따라서 메타버스 사회로급격히 발전하고 있는오늘날 어떠한 법률문제와이슈가 발생할수 있을지 살펴보고, 메타버스의 발전에 따라 변화될 우리 사회모습을 전망해 보아야 한다. 메타버스는 데이터, 네트워크, 인공지능, 가상융합기술 등 정보통신기술의 집약체로 ICT 생태계의 패러다임을 급격히 변화시키고 있다. 이에 따라 미국·유럽 등 주요국은 메타버스를구현하는가상융합기술·인공지능·블록체인등핵심기술개발에중점투자중이며, 우리정부도 “디지털 신대륙, 메타버스로 도약하는 대한민국”을 비전으로 세계적 수준의 메타버스 플랫폼에 도전하고, 메타버스 시대에 활약할 주인공을 키우며, 메타버스 산업을 주도할 전문기업을 육성하고, 국민이 공감하는 모범적 메타버스 세상을 여는 등 계획을 이행해 나갈 예정이다. 메타버스는 잠시 지나가는 단순한 트렌드가 아니라 앞으로 신문명으로 불릴 정도로 세상에 엄청난 변화를 가져올 것으로 예상된다. 메타버스를 통해 산업, 경제, 사회, 문화 등 우리의 일상생활이 더욱 새로운 방식으로 변화될 것이고, 사람들 간 대화뿐 아니라 인공지능을 가진 디지털 휴먼과의 소통도 메타버스에서 이루어질 것으로 전망된다. 이제 메타버스의 의미있는 확대발전에 따라 더욱 안전하고 신뢰할 수 있는 생활이 가능하도록 보다 합리적인 신규입법의 모색과 차별없이 이용가능한 환경이 조성되도록 연구와 검토가 행해져야할 것이다.

영문 초록

Metaverse, which has been discussed a lot recently, refers to a specific space created more specifically than cyberspace, which is an abstract virtual space. In the metaverse, avatars on behalf of users can perform most activities such as various commerce, shopping, real estate transactions, lectures, and leisure activities as if they were real. It is expected that the use of such metaverses will increase and spread, and the world of metaverses will unfold in front of us. In fact, conversations in virtual space are already possible in various forms, but as the term metaverse is newly developed, it is necessary to legally evaluate various actions in the metaverse. For example, how should we view the legal process and effectiveness of commerce transactions conducted on Metaverse, how should criminal responsibility be defined in the event of an unexpected sexual violence incident on Metaverse, and various creations and expressions that occur on Metaverse, i.e., content or Various legal issues are emerging, such as how intellectual property rights for icons should be recognized and defined, and how the legal issues of artificial intelligence should be evaluated when AI, which is rapidly developing in recent years, is applied to avatars in Metaverse. The metaverse world is evolving amazingly. The scope of use of Metaverse goes beyond games, and is expected to spread throughout life, including life, communication, and work. In addition, as the metaverse service spreads, the use of digital human is increasing, and its use is expected to expand to all industries such as entertainment, distribution, education, finance, and broadcasting. Accordingly, a metaverse conversion strategy is required to prepare for the amazing future to come. Accordingly, it is necessary to examine what legal problems and issues may arise today, which is rapidly developing into a metaverse society, and to anticipate the shape of our society that will change according to the development of the metaverse. Metaverse is an aggregation of information and communication technologies such as data, network, artificial intelligence, and virtual convergence technology, and is rapidly changing the paradigm of the ICT ecosystem. Accordingly, major countries such as the United States and Europe are investing heavily in the development of core technologies such as virtual convergence technology, artificial intelligence, and block chain that implement the metaverse, and the Korean government is also making a world-class vision with the vision of a new digital continent, Korea leaping into the metaverse . We plan to implement the plan, such as challenging the metaverse platform of the metaverse, nurturing protagonists who will be active in the metaverse era, nurturing specialized companies to lead the metaverse industry, and opening an exemplary metaverse world that the public can relate to. Metaverse is not just a passing trend, but is expected to bring about a huge change in the world to the extent that it is called the name of a newspaper in the future. Through the metaverse, our daily life, such as industry, economy, society, and culture, will be changed in newer ways, and it is expected that not only conversations between people but also communication with digital humans with artificial intelligence will take place on the metaverse. Now, according to the meaningful expansion and development of the metaverse, research and review should be conducted to find more rational new legislation and to create an environment that can be used without discrimination so that a safer and more reliable life is possible.
