국문 초록

지방자치단체의 권력구조에 있어서도 권력분립에 의한 견제와 균형의 원리의 제도화가 더욱 더 필요해지고 있다. 이를 위해 지방의회의 위상 강화가 필요하다. 지방의회의 위상 강화를 위한 소견은 다음과 같다. 향후 만약 지방자치단체의 기관구성 형태가 기관통합형 구조가 되는 경우에는 지방의회 중심으로 지방행정이 운영될 것이므로, 의회와 집행부 사이의 권한 관계에 관한 전면적인 재검토가 필요할 것이다. 만약 현재와 같은 기관대립형을 전제로 할 경우, 현재의 권한을 적절히 행사할 수 있도록 의회를 지원하는 방안 중심의 모색이 필요할 것이다. 기관대립형을 전제로 방향을 제시하면 다음과 같다. 먼저, 정책지원 전문인력 제도의 활용이 중요하다. 지방의회의 권한은 자치입법과 예산에 관한 것이 가장 중요하다. 따라서 지방의회에서 법률전문가 및 재정전문가의 역할이 확대될 필요가 있다. 기존의 전문위원제도와의 조화적 운영이 필요하다고 본다. 지방의회의 위상과 역량 강화는 지방자치의 실질화를 위해 필수적이다. 다만, 인력과 예산의 증가가 수반되므로, 지방자치단체별로 행정수요와 재정능력에 맞는 적정규모의 조직과 인력을 운영할 필요가 있다. 제도 시행 초기에는 탄력적 운영이 필요할 것이므로, 섣부른 일반직 중심의 인력 운영은 주의가 필요하다고 본다. 학계에서 논의되고 있는 지방의회 직렬 또는 지방감사 직렬의 도입 등의 방안은 적정규모의 조직/인력수준에 대한 대략의 기준을 찾은 후에 다시 검토하는 것이 적절할 것으로 생각된다.

영문 초록

In local governments, the institutionalization of checks and balances is becoming more necessary. And for this mechanism to work properly, it is important to strengthen the status of local councils. The rationales for strengthening the local councils are as follows. In the prospect of local government organizations becoming an institutional joint structure, the local administration will be operated mainly by the local councils — in which case, a full review of the authority relationship between the council and the executive branch will be necessary. If the current institutional separation model continues, it will be necessary to find a way to support the parliament so that the current authority can be properly exercised. On the premise of the institutional separation model, it is importance to capitalize on the policy support professional manpower system. At the core of the local councils’ authority is the self-government legislation and budget; therefore, the role of legal and financial experts in local councils needs to be expanded. It is deemed necessary to operate the councils in harmony with the existing expert committee members system. Strengthening the status and capacity of local councils is essential for the realization of local autonomy. However, since the process requires a considerable increase in manpower and budget, it is necessary for each local government to decide on the appropriate size of the organization and manpower commensurate with its administrative demand and financial capability. Since flexible operation is required at the beginning of the implementation of the system. It would be appropriate to review measures such as the local council series or the local audit series, widely discussed in academia, after deciding on the appropriate size of organization and manpower.
