국문 초록

본 연구는 경찰 직장협의회의 활동이 자치경찰사무의 확정과 관련하여 야기되는 분쟁 사례와 관련 쟁점들을 시론적으로 고찰한다. 경찰 행정은 국민의 생명과 재산을 보호하고 치안 등의 사회의 질서 유지를 담당한다. 이와 같은 역무의 특수성으로 그간 직장협의회의 구성 대상에서는 제외되어 왔다. 그러나 지난 2019년 12월 10일 공무원직협법 개정을 통하여 공무원직장협의회에 가입할 수 있는 공무원의 범위에 경감 이하의 경찰공무원이 추가되면서 경찰 직장협의회 설립이 가능하게 되었고, 2020년 6월부터 경찰 직장협의회가 출범하였다. 경찰 직장협의회는 2021년 7월 1일 자치경찰제가 시행되면서 또다른 국면을 맞이하게 되었다. 자치경찰제는 지방자치제도 도입 목적인 분권의 이념에 따라 지방자치단체에 경찰권을 부여하고, 경찰의 조직ㆍ인사ㆍ예산ㆍ운영 등에 관한 책임을 지방자치단체에 부여한다. 이와 관련하여 경찰청의 사업 예산 확보가 중요해졌으며, 자치경찰사무의 범위를 확정하는 과정에서 지방자치단체와 경찰 조직이 갈등을 빚는 사례가 최근 두드러지고 있다. 조례를 통하여 자치경찰사무가 정해지고, 의견수렴 절차 가운데 경찰 직장협의회가 직접적으로 나서며 개입하고 있기 때문이다. 현재로서는 자치경찰사무의 범위와 경찰 직장협의회의 역할의 한계에 대한 명확한 법리적 해석과 논의가 부족한 상황이다. 규범적으로 허용되는 범위 내에서 자치경찰의 이념에 부합할 수 있도록 자치경찰제의 운용의 묘를 기해야 하며, 입법적 개선 노력도 함께 있어야 한다. 자치경찰사무의 범위에 관하여 상위법령에 보다 명확한 근거를 두어야 할 것이며, 경찰 직장협의회의 특수성을 고려하여 협의 사항의 내용을 분명히 하고, 실효성 있는 운영을 보장할 수 있도록 공무원직협법의 지속적인 보완이 필요하다.

영문 초록

The purpose of this study is to examine the problematic situation that occurred due to the implementation of the autonomous police after the establishment of Police public officials’ council. Police administration is responsible for protecting people s lives and properties and maintaining public order. Due to the specificity of these duties, police have been excluded from the composition of Public officials’ council. However, through the revision of the Public Officials’ Council Act in December 2019, it became possible to establish Police public officials’ council with the goal of improving the working environment of police and monitoring internal police organizations and from June 2020, Police public officials’ councils were launched. Police public officials’ councils entered another phase with the implementation of the autonomous police system on July 1, 2021. The autonomous police system grants police power to local governments according to the idea of ​​decentralization, which is the purpose of the introduction of the local autonomy system, and the organization and personnel management of the police. Conflicts between local governments and Police public officials’ council in determining the scope of autonomous police affairs have recently become prominent. The fundamental reason for the conflict is that the autonomous police affairs are determined through local ordinances and Police public officials’ council directly intervenes in the process. At present, there is a lack of clear legal interpretation and discussion on the scope of autonomous police affairs and the setting of limits on the role of Police public officials’ council. Within the normatively permitted range, the operation of the autonomous police system should be put in line with the ideology of the autonomous police and legislative efforts should also be made. The scope of autonomous police affairs should be clearly grounded in the laws, and the system under Public Officials’ Council Act needs to be improved in consideration of the specificity of the organization and work of Police Public Officials’ Council.
