하천관리 일원화를 위한 법제도적 고찰

국문 초록

2020년 홍수로 인하여 많은 피해가 발생하자 하천관리체계 일원화의 필요성이 높아졌다. 2018년 「물관리기본법」이 제정되었고, 상당 부분 물관리 기능이 환경부로 이관되었지만 하천관리 일원화는 여전히 많은 부분에서 물관리 법체계의 개선 또는 패러다임의 전환을 요구하고 있다. 이에 하천관리의 일원화 및 정책 개선의 측면에서 하천의 상류와 하류, 그리고 수량과 수질의 관리, 시설이나 사업의 측면에서 하천관리 정책의 문제점을 검토하는 한편, 관련 법제도 현황을 살펴보고 각 주체별 역할에 대해 검토함으로써 하천관리 일원화를 위한 정비방향을 설정하고, 중복성의 해소와 효율성의 제고를 강구하고자 한다. 먼저, 하천관리의 개념 정립, 관리사무의 주체를 명확히 함으로써 하천관리의 일원화 기반을 갖추어야 할 것이다. 책임 한계가 모호한 물관리 업무의 특성상, 권한과 책임이 불명확한 상황으로 인해 적극적인 업무수행이 어렵거나 책임 소재를 명확히 파악하기 어려울 수 있다. 이를 위해서 국가와 중앙행정기관, 지방자치단체, 공공기관 등 하천관리의 주체 또는 참여자 간의 역할 변화와 이를 수행할 수 있도록 구체적인 법제도 개선이 요구된다. 다음으로 하천관리 일원화를 위해 하천의 유역 단위 통합관리를 추진할 필요가 있다. 국가하천과 지방하천의 계획 수립에서 유지·관리, 생태계 복원을 비롯한 물환경 보전, 이·치수 기능의 향상, 상·하류의 조화와 수량·수질·수생태를 종합적으로 고려한 유역 단위 통합물관리 정책 추진을 위해서는 조속한 하천관리 일원화 또는 하천관리체계의 정비가 필요하다고 할 것이다. 끝으로 하천관리체계 정비 및 법제도간 정합성 제고를 통해 예산의 중복과 행정의 낭비를 방지할 필요가 있다. 2022년 환경부로의 일원화 이전까지 환경부와 국토교통부의 하천관리사업 중복으로 인한 예산 낭비 문제는 이미 감사원 등에서 지적한 바 있다. 대표적으로 환경부의 생태하천복원사업과 국토교통부의 지방하천정비사업 중복 투자로 인한 경제적 비효율 문제가 지속적으로 제기되었다. 그러나 현 시점에서도 여전히 국가하천과 지방하천간 관리 주체를 달리함으로써 지역의 특성을 고려한 하천관리가 가능하다는 장점은 있으나 유역이나 국가 차원의 통합관리와 기후변화로 인한 재해 예방이라는 측면에서 체계 정합성과 연계성 제고가 요구되며, 관리 주체별 구체적 역할 분장이 필요하다.

영문 초록

As a lot of damage occurred due to the flood in 2020, the need to unify the river management system increased. In 2018, the Framework Act on Water Management was enacted, and to a large extent, water management functions were transferred to the Ministry of Environment, but river management unification still requires improvement or paradigm shift in many areas. In terms of stream management and policy improvement, the problems of river management policy in terms of upstream and downstream of rivers, water quality management, facilities and projects, and roles of each subject are reviewed to establish maintenance directions and improve redundancy. First, it is necessary to establish a unified foundation for river management by establishing the concept of river management and clarifying the subject of management affairs. Due to the nature of water management work, where the limit of responsibility is ambiguous, it may be difficult to actively perform the work or clearly identify the whereabouts of responsibility due to unclear authority and responsibility. To this end, it is required to change the role of the main body or participants in river management, such as the state and central administrative agencies, local governments, and public institutions, and to improve the specific legal system. Next, it is necessary to promote integrated management of river basin units in order to unify river management. It is necessary to unify river management or improve the river management system as soon as possible in order to maintain and manage national and local rivers, preserve the water environment, water quality and quality. Finally, it is necessary to prevent overlapping budgets and waste of administration by improving the river management system and improving consistency between legal systems. Before the unification of the Ministry of Environment in 2022, the Ministry of Environment and the Ministry of Land, Infrastructure and Transport had already pointed out the problem of budget waste due to overlapping river management projects. Representatively, the issue of economic inefficiency continued to be raised due to overlapping investments in the Ministry of Environment s ecological river restoration project and the Ministry of Land, Infrastructure and Transport s local river maintenance project. At this point, however, river management is still advantageous in consideration of regional characteristics by different management entities between national and local rivers, but system consistency and linkage are required in terms of integrated management and disaster prevention due to climate change.
