국문 초록

본 연구는 한국이 권위주의 시기에서 민주화 시기로 이행하면서 경찰관련 협력단체를 어떻게 조직화하고 이를 치안목적을 위해 활용하였는가를 분석한다. 사회를 조직화함으로써 국가의 법집행 능력을 증대시키고자 하는 시도와 정책은 민주화 이행이전과 이후 시기에 걸쳐 공통적으로 발견된다. 그러나 시기별로 협력단체가 구성되고 활용되는 방식에 있어 차이점이 존재한다. 민주화 이전 시기에는 국가에 의해 폐쇄적인 관변단체가 조직화됨과 동시에 민간주도로 만들어진 조직이 국가에 의해 관리되는 방식이 나타났다. 이를 통해 국가는 치안유지를 위한 비용을 줄일 수 있었으나 부패와 비효율성의 문제가 나타났다. 반면 민주화 이후 시기에는 관주도로 만들어진 조직과 함께 개방성과 자율성을 지닌 민간단체가 활용되는 다변화된 방식이 나타났다. 그러나 단체에 대한 정치적 활용, 국가-단체 유착으로 인한 법집행 방해, 그리고 탈법적 방식으로 이루어지는 법집행 문제가 나타났다. 이는 치안 목적을 위해국가가 협력단체를 활용하는 것이 국가의 법집행 능력을 보완하는데 기여하지만 공정한 법집행에 부정적인 영향 또한 초래할 수 있음을 말해준다.

영문 초록

This study investigated how the police in South Korea utilize cooperative organizations in the social sector to maintain public safety. The use of social organizations by the state to increase its law enforcement capacity has been embodied in government policies during both the authoritarian and democratic periods. However, such cooperative organizations were formed and used by the state in different ways during the authoritarian and democratic periods. Before democratization, the state built up cooperative organizations with closed memberships in a top-down manner and managed these organizations. This policy reduced the state’s costs in maintaining public safety but resulted in corruption and inefficiencies. In contrast, the governments after democratization have utilized various cooperative organizations, including both state-led and autonomous organizations with open memberships formed from the bottom up. Nevertheless, the use of these organizations has led to the politicization of the organizations, collusion between the police and the private sector, and enforcement through illegal methods. This study shows that the use of cooperative organizations by the state for public safety can have negative effects on impartial law enforcement even though it may complement the state’s capacity for maintaining public safety.
