국문 초록

채권자취소권의 연혁적 의미와 각국에서의 계수 및 법제화에서는 각각의 특성을 보이고 있다. 우리 민법의 경우, 입법과정에서 구민법에서의 조항에 대한 논의에서 출발하여 원상회복을 규정함으로써 채권자취소권의 본질에 대한 논의가 중요하게 되었다. 채권자취소권의 본질은 자신의 채무의 이행을 통해 채권을 만족시킬 의무를 부담하는 채무자가 악의적이거나 불성실한 행위에 대해 예외적으로 부인하는 것이다 즉, 채무자의 재산감소행위를 부정하고, 그 재산을 채무자에게 복귀시킴으로써 채권자의 채권을 만족시킬 수 있도록 보호하는 것이다. 현행 민법상 채권자취소권의 효력 중 원상회복의 문제는 부동산경매의 과정에서도 중요한 변수가 될 수 있는 것으로, 본고에서는 채권자취소권의 성질에 기초하여 부동산 경매의 배당금 수령시 등에서 발생할 수 있는 문제에 대해 고찰하고 문제해결을 위한 개선방향을 제시하였다.

영문 초록

The historical meaning, acceptance and legislation of the creditor s right of revocation differ among nations. In case of our Civil Law, the discussions about its legislation started from those about the clauses of the Previous Civil Law, and in this process the principle of restoration was agreed to and thereby, the discussion about the essence of creditor s right of revocation would be important. Under the current principle of creditor s right of revocation, the debtor s malicious or insincere acts shall be revoked if he or she reduces his/her chargeable properties only to make the creditor s rights not satisfied. Namely, the debtor s asset-reduction acts shall be revoked, and therefore, the assets shall be returned to the debtor to protect creditor s receivables. Under the current Civil Law, the restoration would be an important variable in the process of real estate auction. Based on such attributes of the creditor s rights of revocation, the researcher reviewed the possible problems rising in the process of the real estate auction, and thereby, suggested some reform measures to solve such a problem.
