국문 초록

부동산매매에서 매수인은 금융기관에서 대출을 받아 매매대금을 지급하는 경우가 많다. 대출특약은 매수인이 예정하고 있던 조건으로 대출을 받지 못할 경우에 대비한 매매계약서상 특약조항이다. 즉, 매수인이 대출을 받지 못할 경우 매매계약을 무효로 할 수 있다. 그러나 매매계약에 대출특약이 있는 경우 그 대출을 받지 못한 원인, 매수인의 대출신청 및 노력의무 인정여부, 대출특약의 적용여부 및 그 효과 등을 둘러싸고 분쟁이 발생할 수 있다. 본고에서는 대출특약조항에 관해 해석상 제기되는 제 문제를 검토하여, 부동산거래 실무상 발생할 수 있는 분쟁의 해결에 참고가 될 수 있도록 하였다.

영문 초록

A loan rider refers to an additional provision added to a real estate sale and purchase contract with a purpose to prepare for a contingency when the purchaser fails to receive a loan which was planned with certain conditions. That is, if the purchaser fails to receive the loan (in the case of nonfulfillment of the loan), the sale and purchase contract can be nullified. However, in the interpretation of the contract, issues about the definition of nonfulfillment of the loan, issues about whether to recognize the purchaser s application for loan and the effort to fulfill the obligation, and issues about the effect of the loan rider can be raised. Therefore, this study explores various issues in the interpretation of provisions on loan riders. This study also has the purpose of providing resources for the settlement of disputes that can be raised in real estate transaction practices.
