국문 초록

음악 실기 교육은 그동안 온라인상의 수업이 쌍방간 전달력과 역량 측정 판별 면에서 미흡할 수 있는 한계로 전통적인 교육 방식을 고수해 왔다. 그러나 코로나 19 이후 수업 방침이 비대면 중심으로 정해지면서 음악 실기 교육 또한 온라인상 에서 수업이 편리하도록 형태가 크게 바뀌어야 했다. 음악 실기 교수자들은 비대면 음악 실기 교육의 한계를 극복하기 위해 다양한 예시의 음악 저작물을 활용하여 비대면 수업의 질을 높이고자 하였다. 그러나 현행 저작권법에서는 교육목적의 음악 저작물 이용에 따른 저작권 침해에 대한 문제가 나날이 대두되고 있는 형편이다. 비대면 음악 실기 교육 콘텐츠의 저작권 문제를 선행연구와 참고문헌을 통해 조사한 결과 첫 번째, 기존 콘텐츠를 활용한 음악 실기 교육 콘텐츠의 저작권 침해 문제는 더욱 늘어날 것으로 예상되었다. 두 번째, 현행 저작권법에서 음악 실기 교육 콘텐츠의 법적 지위와 권리처리에 대해 알아본 결과, 저작인격권의 저작 재산권적 속성으로 인해 이용허락에 따른 2차적 저작물 작성권의 획득 여부와 관계없이 저작권 침해가 발생할 수 있음을 알 수 있었다. 세 번째, 수업목적 저작물 관련 조항들에서도 권리 간 충돌이 발생하며 수업목적 보상금 기준이 낮아 원저작자의 이용허락을 받기 어렵다는 것을 알 수 있었다. 네번째, 인터뷰를 통한 사례 연구 결과 저작인접권 침해 가능성도 볼 수 있었다. 본 연구는 음악 실기 교육 콘텐츠 관련 저작권 문제의 법적 쟁점을 검토하고 개선 방안을 모색하여 해결 방안을 제시하였다는 데 그 의의가 있다.

영문 초록

Practical music education has not been performed as a non-face-to-face online class in Korea. There could be a lack of interaction between the instructor and the learner, and it is not easy to evaluate the learner s competency. As a result, practical music instructors have adhered to the traditional face-to-face teaching method for the above reasons. However, after the COVID-19 pandemic in Korea, classes in domestic education sites have been converted to non-face-to-face online methods, and practical music education has also been conducted online. To overcome the limitations of the non-face-to-face music practical education method, practical music instructors have tried to improve the quality of the non-face-to-face class by using various types of music creations. However, the possibility of copyright infringement has been raised by the current Korean Copyright Act for music creations for educational purposes used in non-face-to-face music practice education. This research was conducted focusing on literature studies and case studies on the copyright issue of non-face-to-face music practical education contents. The results of this study were derived as follows. First, this study expects practical music education using existing music content will cause more copyright infringement problems. Second, this study conducts the legal status and related rights analysis of music practical education content under the current Copyright Act. This study finds that the current law recognizes the copyright property nature of personal rights of authorship. Therefore, this study confirms that copyright infringement may occur regardless of whether or not the copyright holder has obtained the right to write a secondary work with the copyright holder s permission to use music content. Third, this study reveals a mutual conflict between legal rights provisions in the conditions related to copyrighted works for music classes. In addition, this study finds it difficult to obtain permission from the original author because the compensation standard for the copyright of music class content is still low. Fourth, the case study demonstrates the possibility of copyright infringement in practical music education. This study is meaningful since it examines the legal issues related to copyright of practical music education content, proposing solutions by seeking improvement measures.
