자치경찰제 도입의 법적 의미와 개선방향에 대한 고찰

국문 초록

1948년 정부조직법 제정 당시부터 70여 년간 지속적으로 논의해온 자치경찰제가 올해서야 비로소 본격 시행되어 운영중에 있다. 헌법에 규정된 지방자치가 일반행정, 교육에 이어 경찰까지 외형적으로 완성되어 일각에서는 자치경찰제가 지방자치의 완결판이라고도 한다. 제도 출범을 위해 지난 수십 년간에 걸쳐 논의되었을 정도로 자치경찰제는 국민의 생명과 안전에 직결되는 중요한 사안을 다루고 있고, 각종 범죄의 과학화･첨단화･국제화 등 급변하는 치안환경 속에서 헌법이 보장하는 지방자치 구현과 국가경찰의 안정된 치안역량 유지 등 검토사항이 많은 것이 사실이다. 또한, 자치경찰제를 오래전부터 운영해왔던 미국, 영국, 케나다 등에서 교통･통신 및 인터넷･SNS 등 과학기술의 발달로 인한 광역범죄, 대규모 치안사태 등 환경 변화에 대응하여 치안에 대한 국가의 관리와 조정기능을 강화하는 추세를 고려할 필요도 있다. 현행 자치경찰제도에 대한 평가가 찬반이 교차되고 있는 것도 이러한 배경과 관련되어 있다고 본다. 지방자치를 중시하는 입장에서는 부족함과 한계가 있을 수 있지만 국가경찰의 치안력을 유지하고 코로나19 등에 기인한 재정적 부담 속에서 자치경찰제도를 도입하기 위한 한국형 자치경찰의 현실적 모델임을 감안하여야 한다. 그간 오랜기간에 걸쳐 많은 고려 요인을 심도있게 논의하여 만들어진 자치경찰제도가 이제는 안정적으로 정착하여 발전해 나가는 것이 중요하다. 지역 현장에서 주민의 의사와 지역 특성에 맞는 치안정책이 수립되고 이를 집행하고 그 결과를 평가해서 치안정책을 다듬어가는 일련의 ‘자치경찰 선순환 과정’이 자치경찰위원회와 경찰사이에 이루어져야 할 것이다. 이를 위해 현행 모델에서 중추역할을 수행하는 자치경찰위원회가 치안전문성과 역량을 강화하고 치안 정책 수립과 평가에 주민의 자발적 참여를 확대해 나가야 한다. 기관차원에서는 시･도, 자치경찰위원회, 경찰기관이 상호 신뢰를 바탕으로 긴밀히 협의해나갈 때만이 가능하다. 완벽한 제도는 존재하지 않는다. 지방자치의 이념과 안정된 치안유지라는 두 마리 토끼를 잡기 위해 자치경찰 활동의 방점을 오로지 지역 주민의 안전과 복리증진에 두면서 부족한 부분을 보완해 가는 것이 현재로서는 보다 나은 자치경찰제 구현을 위한 최선의 방안이라고 본다.

영문 초록

The autonomous police system, which has been continuously discussed for 70 years since the enactment of the Government Organization Act in 1948, is in full operation only this year. The local autonomy prescribed in the Constitution is completed in general administration and education, followed by police, and some say that the autonomous police system is the final version of local autonomy. The autonomous police system has been discussed for the past few decades, and it is true that there are many matters to be reviewed such as the implementation of local autonomy guaranteed by the Constitution and the maintenance of stable security capacity of the national police in a rapidly changing security environment such as scientific, advanced, and internationalization of various crimes. In addition, it is necessary to consider the trend of strengthening the national management and coordination function of security in response to environmental changes such as wide-area crime and large-scale security due to the development of science and technology such as traffic, communication, internet, and SNS in the United States, the United Kingdom, and Canada, which have been operating the autonomous police system for a long time. It is also related to this background that the evaluation of the current autonomous police system is crossing the pros and cons. Although there are many shortages and limitations in the position of emphasizing local autonomy, it should be considered that it is a realistic model of Korean autonomous police to maintain the security of the national police and to introduce the autonomous police system under the financial burden caused by Corona 19 and others. It is important that the autonomous police system, which has been created by discussing many factors in depth over a long period of time, should be now stable and developed step by step. A series of ‘self-governing police virtuous cycle process’ that establishes and enforces the security policy that fits the residents will and local characteristics in the local field and evaluates the results and refines the security policy should be done between the autonomous police committee and the police. To this end, the autonomous police committee, which plays a pivotal role in the current model, should strengthen the expertise and capacity of security and expand the voluntary participation of residents in establishing and evaluating security policies. At the institutional level, it is only possible when the local government, autonomous police committee, and police agency closely cooperate on mutual trusts. There is no perfect system. In order to catch two rabbits, the ideology of local autonomy and stable security, it is considered that the best way to implement a better autonomous police system at present is to supplement the deficiencies while keeping the point of autonomous police activities only to the safety and welfare of local residents.
