‘아기상어(Baby Shark)’의 표절 논란과 음악저작물의 실질적 유사성 판단기준

국문 초록

우리나라 유아 콘텐츠 제작사 스마트스터디에서 2015년 발표한 ‘아기상어’라는 노래는 “아기상어 뚜루루 뚜루 귀여운 뚜루루 뚜루∼”로 이어지는 중독성 강한 멜로디와 깜직한 율동이 담긴 영상으로 전세계적으로 인기를 끌었다. 그런데 2018년 미국 동요 작곡가 조니 온리(Johnny Only)로부터 표절 의혹을 받게 되어 많은 사람들을 놀라게 하였다. 서울중앙지방법원은 2021년 7월 23일 스마트스터디의 ‘아기상어’는 조니 온리의 ‘Baby Shark’ 저작권을 침해하지 않았다면서 그 근거로 한국저작권위원회 감정 결과를 제시하였다. 나아가 법원은 피고 곡에서는 원고 곡에서 사용한 조성(Key) 변경이 발견되지 않으며, 디스코 장르라기 보다는 하우스 댄스에 가깝다는 점 그리고 신디사이저스트링, 피아노, 보컬 및 코러스 등을 이용하여 편곡을 다르게 하였다는 점을 근거로 실질적 유사성을 부정하였다. 본 논문에서는 이와 관련하여 음악저작물 표절 논란에서 저작권 침해 판단기준에 대하여 검토해보았다. 구체적으로 창작적 표현 판단 시 단순한 도구 변경과 개성적 모습을 구분해야 한다는 점, 의거 또는 복제 요건과 관련해서는 저작물 이용 환경 변화를 감안하여 접근가능성을 해석해야 한다는 점, 실질적 유사성 판단과 관련해서는 판단의 방법이나 주체 등 체계적 기준을 마련할 필요가 있다는 점 등의 논리를 제시하였다.

영문 초록

The song ‘Baby Shark’ released in 2015 by Smart Study, a Korean children s content production company, was popular worldwide with its addictive melodies and cute dance videos. However, in 2018, he surprised many people when he was accused of plagiarism by the American nursery rhyme composer Johnny Only. On July 23, 2021, the Seoul Central District Court stated that Smart Study s ‘Baby Shark’ did not infringe on Johnny Only s ‘Baby Shark’ copyright, and presented the results of the Korea Copyright Commission s evaluation. Furthermore, the court found that it was closer to a house dance rather than a disco genre, and that the arrangement was different using synthesizer strings, piano, vocals and choruses. In this paper, the criteria for judging copyright infringement in the controversy over plagiarism of musical works were reviewed. Specifically, when judging creative expression, it is necessary to distinguish between a simple tool change and an individual production, accessibility should be interpreted in consideration of changes in the environment for using the work in relation to the requirements for compliance or reproduction, and the method of judgment in relation to the determination of substantive similarity The logic of the need to prepare systematic standards such as the subject and the subject was presented.
