국문 초록

1987년 헌법에 대해서는 처음부터 개정의 필요성이 지적되었고, 또 현재까지 여러 헌법개정안이 작성되었다. 그럼에도 불구하고 1987년 헌법이 우리 헌법사에서 유례없이 장수(長壽)하고 있는 것은 1987년 헌법이 민주화의 헌장으로서 국민적 신뢰가 뚜렷하고, 헌법재판과 헌법학 연구를 통하여 개정 당시의 시대적 한계와 이후 시대의 변화를 헌법의 운영에 반영하여 기능을 유지할 수 있었기 때문이다. 이 점이 헌법개정에 있어서 존중되어야 한다. 즉 헌법개정은 헌법의 기능을 유지하거나 혹은 기능 유지에 우호적인 환경을 위하여 이루어져야 한다. 이때 다음과 같은 사고의 단계가 필요하다. 기본권은 전체 헌법질서를 구성하며, 기본권 질서에 편입되어 기능한다. 따라서 헌법질서, 그리고 기본권 질서와의 정합성이 유지되어야 한다. 또 해당 기본권이 실제 국민의 주관적 지위를 향상하고, 이를 위하여 우호적인 거시질서를 조성하는 데 기여하여야 한다. 그렇지 않을 경우 헌법개정은 소모적이다. 기본권의 개정은 헌법재판 등 공적 과정에서 기본권으로 인정된 권리를 보충하거나 새롭게 인식된 기본권을 도입하는 작업이다. 이때 헌법개정은 국민적 합의에 의한 정치적 결정으로서 국민통합을 지향한다는 관점이 이미 의제를 설정하는 단계에서 존중되어야 하며, 기본권 개정의 논의 자체가 새로운 분열의 원인이 되어서는 안된다.

영문 초록

The necessity of the amendment was considered from the beginning on and in fact various drafts were written to date. Nonetheless this constitution has been effective for a long period of over 30 years. This results from the fact that the trust to the constitution was deeply rooted in the consciousness of the people and the constitution well functioned taking into account timely limit of that period as well as the varying political and socio-economic changes since that period. This was the contribution of the constitutional court and the constitutional law research. These perspectives should be respected also in the discourse on the constitutional amendment. It means that the constitutional amendment should aim to maintain the function of the constitution or to create the amicable conditions to that. Then the structural thinking is needed as follows. The individual fundamental rights are the part of the whole constitution and function in the order of the whole fundamental rights. It evitably requires the confirmity of the amendment with the constitution as a whole as well as the order of the fundamental rights. The addition of the fundamental rights should contribute to improve the individual status and to create the macro order necessary to achieve it as well. Otherwise the constitutional amendment stays in vain. The constitutional amendment of the fundamental rights is to introduce the rights recognized in the public discourse as the constitutional juridiction or the newly aware of the civic life. The constitutional amendment should be at this time the result of the political decision based on the people’s consensus. And this aspect should be taken account of already in ther preparation of the draft. Otherwise the constitutional amendment would be deteriorated much more to the segmentation than to the integration.
