국문 초록

최근 우리 사회는 남녀 차별, 특히 병역의무에 대한 논쟁이 한창이다. 그러므로 본고에서는 ｢병역법｣ 제3조 제1항 전문이 평등권을 침해하는지에 대하여 판단한 최초의 우리 헌법재판소의 결정, 헌법 제39조 제1항에 규정된 ‘국방의 의무’의 근간을 이루는 병역의무가 성별에 의하여 차별적으로 적용되고 있다는 사실에 대하여 본안판단을 한 최초의 결정인 헌법재판소 2010. 11. 25. 선고 2006헌마328 결정에 대해 젠더적 관점에서 살펴보았다. 우리는 헌법재판소의 결정문을 통해 헌법상 의무를 차등 부과하는 경우 그 판단기준이 무엇이며, 병역의무를 이행함에 있어 성별에 의한 차별이 발생하는 원인이 무엇인지에 대한 사법부의 가치관을 확인할 필요가 있다. 따라서 본고에서는 헌법재판소의 2006헌마328 결정을 개괄(Ⅱ)한 후, 기본의무로서 병역의무(Ⅲ)를 살펴보고, 헌법재판소의 판단기준(Ⅳ)과 차별근거(Ⅴ)에 대해 비판적으로 검토하였다.

영문 초록

Recently, in our society, there is a debate about gender discrimination, especially the military service obligation. Therefore, this paper examines the decision of the first Korean Constitutional Court to judge whether the preamble of Article 3, Paragraph 1 of the Military Service Act violates the right to equality. In particular, this decision is the first decision to explicitly judge that the duty of national defense stipulated in Article 39 Paragraph 1 of the Constitution is applied discriminatory by gender. We need to confirm the value of the judiciary on what is the criterion for judging the differential imposition of constitutional obligations through the decision of the Constitutional Court and what causes discrimination based on gender in relation to the fulfillment of military service obligations. Therefore, in this paper, after an overview of the decision of the Constitutional Court (II), the mandatory military service as a basic duty (III)) was reviewed, and the judgment criteria (IV) and the grounds for discrimination (V) of the Constitutional Court were reviewed from a gender perspective.
