국문 초록

베트남의 토지등록제도는 수 세기 이상 존재하였으며, 행정 목적에 적합하도록 여러 왕조와 정권들에 의해 수십 차례 수정되어 상당히 과학적인 토지등록제도가 구축되었다. 그러나 전쟁과 국가의 분단으로 인하여 토지등록시스템은 지역과 국가 체제에 따라 달랐다. 프랑스 식민지 시대에는 소유권과 사용권이 오늘날과 같이 분리되지 않았지만, 베트남 역사상 처음으로 소유권과 사용권을 동시에 존재하며 법으로 보호받는 제도로 발전되었다. 그러나 베트남에서는 통일과 토지소유제도의 변경으로 토지등록이 중단되었다. 이는 오래된 지적공부가 훼손되어 국민 전체의 토지 소유에 따른 새로운 제도에 적응하지 못하였기 때문이다. 이런 이유로 베트남의 토지등록은 국가 발전에 따라 변경되어 거의 처음부터 새로 시작되어야 했다. 최근 몇 년간 토지등록에 대한 성과가 있었지만 효과적이지는 못했다. 따라서 베트남은 토지등록제도 개선을 위한 노력을 계속하여야 할 것이다.

영문 초록

Vietnam s land registration system has existed for more than several centuries, and has been revised dozens of times by various dynasties and regimes to suit administrative purposes, resulting in a fairly scientific land registration system. However, due to the war and the division of the state, the land registration system differed according to the regional and national system. During the French colonial era, the ownership and usage rights were not separated as they are today, but for the first time in Vietnam s history, both ownership and usage rights were at the same time and developed into a system protected by law. However, in Vietnam, land registration was suspended after reunification and changes in the land ownership system. This is because old cadastral books have been damaged and they have not been able to adapt to the new system based on the land ownership of the whole people. For this reason, Vietnam s land registration had to be started almost from scratch, with changes according to national development. There have been some achievements in land registration in recent years, but they have not been effective. Therefore, Vietnam should continue its efforts to improve the land registration system.
