국문 초록

외상후스트레스장애(PTSD)의 개념적 미완결성과 진단기준의 불확정성으로 인해, 외상후스트레스장애는 죄형법정주의, 특히 명확성원칙이 준수되어야 하는 형법상의 법개념이 되기 어렵다. 그러나 판례(대법원 98도3732)는 외상후스트레스장애의 개념을 명시적으로 사용하면서 그 증상이 강간에 통상 수반되는 결과가 아니면서 6개월 간의 치료를 필요로 하는 경우에 상해를 인정한 바 있다. 이런 상해인정으로 인해 강간범에게 적용되는 다양한 강간치상죄의 법정형은 살인죄의 법정형 그 이상으로 중해진다. 즉 외상후스트레스장애의 상해 인정이 명확성원칙을 훼손하며 이루어지고, 그 결과 법정형이 과도하게 높아짐에 따라 비례성원칙을 훼손하는 이중의 문제가 발생하고 있다. 강간치상에서 상해개념의 외연을 좁게 설정하면 이와 같은 불명확성과 죄형불균형(과잉형벌)의 문제가 동시에 줄어들 수 있을 것이다.

영문 초록

Due to the conceptual incompleteness of post-traumatic stress disorder (PTSD) and uncertainty in diagnostic criteria, post-traumatic stress disorder is difficult to become a legal concept in criminal law, especially in accordance with the void for vagueness. However, the Supreme Court, which explicitly used the concept of post-traumatic stress disorder, admitted injury when the symptoms were not usually the result of rape and required treatment for six months. According to this recognition of injury, the legal punishment for rape and injury will be heavier than those for murder. In other words, the injury recognition of post-traumatic stress disorder is carried out without compromising the void for vagueness, resulting in a double problem of damage to the Principle of Proportionality due to excessive legal punishment. By narrowing the scope of the concept of injury in the context of rape, the problems of such ambiguity and criminal imbalance (excessive punishment) can be reduced at the same time.
