산재근로자 원직복귀의무제도 도입논의와 과제

국문 초록

본 연구에서는 산재근로자 원직복귀문제를 보다 효과적으로 해결하기 위해 원직복귀지원제도에 대한 필요성과 더불어 외국의 원직복귀의무제도 및 지원제도를 살펴봄으로써 우리나라 원직복귀의무제도 도입을 위한 논의점을 살펴보았다. 그 결과 산재근로자 원직복귀 의무제도 도입을 위한 다음과 같은 제도적 논의점들을 발견하였다. 첫째, 원직복귀 주치의 소견제도 도입을 통해 산재근로자 직무능력에 대한 객관적 정보 확보가 우선되어야 한다. 둘째, 원직복귀 시 사업주 욕구해결을 위한 현실적인 지원이 제공되어야 한다. 셋째, 산재근로자를 원직복귀시킨 사업주의 해당 산재근로자에 대한 민사상책임면제제도를 도입함으로써 사업주 부담과 산재근로자 복귀문제를 해결하는 방안을 검토할 필요가 있다. 넷째, 산재보험법 내 산재근로자 원직복귀의무조항을 도입하고, 사업주와 산재근로자, 고용노동부 3자의 협력의무를 통해 제도를 운영할 필요가 있다. 다섯째, 사업주 우려를 해소하기 위해 원직복귀이후 해당 산재근로자가 2차 재해가 발생하더라도 개별실적요율에 반영하지 않도록 제도화시키는 것을 검토할 필요가 있다.

영문 초록

This review paper attempted to discuss what measures need to be taken in order to introduce and implement a mandatory return-to-work provision among industrially injured workers as a viable option to tackle a problem of re-entry to the labor force by presenting return to work practice and policies of other countries. Based on this review, authors were able to come up with following suggestions in order to fully and effectively implement a mandatory return-to-work practice for workers with industrial injury. First, an objective way to collect information regarding residual work capability by requiring employers to get a doctor s opinion. Second, measures to provide realistic and meaningful incentives and supports to meet employers desires and needs are to be taken into consideration. Third, liability without fault policy needs to be introduce in order to protect employer, who hired an industrially injured worker, from potential lawsuits. Fourth, it is recommended to amend the Workers compensation law in order to include a provision of mandatory return-to-work practice and to operate this newly implemented provision based on the mutual cooperation among employers, workers, and the government. Finally, in order to relieve employers concerns about rise of insurance rate in case an industrial injury reoccurs to the worker who got back to work.
