사이버 공간에서의 표현의 자유의 범위에 대한 법적 소고

국문 초록

본 연구는 각종 인터넷 커뮤니티를 중심으로 혐오표현이 증가하는 오늘날의 사회에서 표현의 자유가 가지는 의미에 대하여 돌이켜 보고 헌법상 보호되는 표현의 자유의 범위에 관하여 고찰하는 것을 목표로 한다. 우리 사회에서 표현의 자유와 관련하여 이루어지고 있는 논의의 흐름은 과거의 논의와는 다소 다른 양상을 보인다. 과거에는 방송국과 신문사를 중심으로 한 주요 언론기관들이 주로 표현의 자유의 주체로 논의되었다. 하지만 오늘날은 정보통신 기술의 발달로 개인 또한 미디어의 중심이 되는 사회로 변모하였다. 이에 따라 비슷한 생각을 공유하는 개인들이 모여 각종 인터넷 커뮤니티를 활성화시키면서 다양한 공론의 장을 형성하게 되었다. 이러한 공론의 장은 서로 다양한 의견을 주고받으며 건전한 비판과 토론이 이루어지는 긍정적인 공간이 되기도 하지만, 그와는 반대로 혐오표현을 담은 악성 게시물을 주고받으며 타인을 모욕하고 인격권을 침해하는 사회적 폭력의 공간이 되기도 한다. 특히 일간베스트 저장소라는 커뮤니티의 악성 게시물들이 사회적으로 많은 논란이 되면서 혐오표현에 대한 대중의 우려 또한 커지고 있다. 표현의 자유가 민주주의의 실현의 측면에서 절대적인 가치를 지닌다는 점을 부인하기 어려우나 이것이 곧 표현의 자유의 범위를 절대적으로 보장하는 것을 의미하는 것은 아닐 것이다. 따라서 필자는 이러한 표현의 자유의 범위에 대한 논의의 필요성에 입각하여 혐오표현 또한 우리나라 헌법 제21조에서 보장하는 표현의 범위에 해당하는지 판단해보고, 혐오표현 문제를 해결하기 위한 규제방안에 관하여 모색해보고자 하였다. 우선 혐오표현 규제에 관한 논의의 배경을 살펴봄으로써 혐오표현의 규제의 필요성에 대해 인식하고 혐오표현 규제에 관한 일반론 및 외국의 입법례를 살펴보고자 하였다. 다음으로 우리나라 입장에서 혐오표현에 대한 규제방안에 관하여 법적인 규제와 사회적 자정작용 활성화를 통한 규제의 측면으로 나누어서 구조적 차원의 개선 방안 및 개인적 차원의 개선 방안에 대하여 고찰해보고자 하였다.

영문 초록

This article aims to review the meaning of freedom of speech and its range in cyber space, which is guaranteed by the Korea’s constitutional law. The current flow of discussion about freedom of speech has somewhat different aspects from that of many years’ ago. In the past, media publishers were the only subjects of the discussion about freedom of speech. However, these days, that has changed because of Development of Information and Communication Technology(ICT) which allows each individual to play an active role in multi-media. As a result, people sharing similar ideas come together and form a variety of communities on the Internet. The public spaces on the Internet create a positive atmosphere where everyone can freely give constructive criticism to one another, while they on occasion brings about some problems such as invasion of personal rights of others. In this perspective, freedom of speech on the Internet spaces has become controversial today mainly due to a website called “Ilbe” in which a number of malicious posts are uploaded everyday by unknown users. Freedom of speech makes it possible to establish the true value of democracy. Nonetheless, it would not mean that people should be absolutely allowed to express whatever they wish. Therefore, it has been reviewed that if the malicious expressions should be covered within the boundary of freedom of speech that is guaranteed by the Korea’s constitutional law section 21. After that, the efforts that try to seek the solutions to the problems caused by the malicious expressions have been made in this paper. First of all, by looking at the background of discussion on hate speech, it has been reviewed to seek the needs to regulate hate speech and how other countries deal with it. Next, in Korea’s perspective, the ways to regulate hate speech through legal methods and through social changes are suggested in this paper.
