군인에 대한 징계 제도의 법적 개선에 관한 연구

국문 초록

한반도의 지정학적 위치와 남북 분단의 현실 등을 고려할 때 국가의 존립과 안전 및 국민의 생명과 재산을 보호하기 위해서는 강력한 국방력을 구비하는 것이 필요하다. 이에 우리나라도 현대화전의 특성에 따라 최신식 첨단 무기의 도입과 개발은 물론 관련 제도의 정비에 박차를 가하고 있다. 그러나 중국 춘추전국시대의 병법서인 손자병법에서도 언급하고 있듯이, 우리가 강력한 국방력을 구비하기 위해서는 그 기반으로서 병력에 대한 사기 증진을 통한 전투력 향상이 최우선시 되어야 하고, 적법절차에 의한 법령의 이행과 병력에 대한 상벌이 명확하여야 한다. 우리도 최근 군인에 대한 벌로서 징계 제도에 관한 대대적인 개선의 노력이 진행중인데, 특히 병에 대한 징계 제도의 법적 개선에 관하여 다음의 것들도 함께 논의하여 도입을 고려하는 것이 타당하다고 생각된다. 첫째, 다른 공무원이나 같은 군인의 신분을 갖는 군인 간부와 같이 병에 대해서도 징계 내용상의 경중을 구분할 필요가 있다. 둘째, 현행 징계 내용의 개선 및 보완책으로 제한되는 휴가의 종류를 명시하고, 영창의 횟수에 대한 상한을 규정하며, 영창처분 일수가 복무기간에 산입되도록 현행 법률을 개정함이 필요하다. 셋째, 병에 대한 징계 내용에 추가적으로 경고처분, 얼차려 내지는 군기교육대 입소 등을 도입하여 다양화할 필요가 있다. 그리고 마지막으로 징계처분의 절차상의 개선책으로 자의적인 징계 절차의 진행을 지양하고, 실질적 적법절차에 의한 징계 절차가 진행되도록 하고, 징계 업무에 관련된 군인 간부에 대한 교육 강화는 물론, 더 나아가 중징계의 경우 현행과 같은 징계위원회에 의한 처분으로, 경징계의 경우 징계권자 내지는 지휘관의 명령에 의한 처분으로 징계가 이루어지는 징계 절차의 이원화를 고려해 볼 가치가 있다고 생각된다. 현재까지 우리나라는 징병제를 기본으로 하고 있으므로, 입대한 병에 대한 인신상의 불이익 처분에 대하여는 적법절차를 더욱 준수할 필요성이 있다. 정부의 개선 노력에 의하여 과거에 비하여 비약적인 개선이 있었다고 평가될 수 있겠으나, 향후의 개선에서는 형식적·체계적인 개선이 중심이 되는 것이 아니라, 현재 군 복무중인 병력들이 체감하여 사기가 진작되고 전투력이 향상될 수 있도록 실질적·효과적인 개선이 이루어지도록 하여야 할 것이다.

영문 초록

Considering the geopolitical position of the Korean peninsula and the Korean(North and South) division, it would be necessary to be equipped with a strong defense power for protecting the national existence, security and life and property of the public. Therefore, we have introduced and developed the most advanced state-of-the-art weapons in accordance with the aspects of modern warfare, and also modified various laws and regulations concerned. However, as mentioned in the Art of War which is the war manual by Sun Tzu in ancient China, the most important thing to be equipped with a strong defense power is the military personnel. Thus, it would be essential for the military personnel to enforce the law by the due process and for the reward and punishment to be clarified. Although we have reformed a disciplinary system, it would be appropriate to introduce the following things about legal improvement in the disciplinary system against enlisted personnel. First, Disciplinary measures against enlisted personnel shall be classified into heavy disciplinary measures and minor disciplinary measures, such as officers, warrant officers, and noncommissioned officers. Secondly, Restriction on the kind of leave shall be clarified, and the limit of the numbers regarding detention in a guardhouse shall be provided. And detention period shall be included into the total service period. Thirdly, We would need to diversify disciplinary measures for enlisted personnel by providing caution and military discipline training center. Fourthly, The disciplinary procedures in a disciplinary committee shall be processed in due process, and the education for the persons with authority shall be reinforced, and it would be worth considering the differentiation for disciplinary procedures against enlisted personnel.
