공인탐정법 / 민간조사업법 올바른 법제도화에 따른 연구방안

국문 초록

사회가 선진화됨에 따라 범죄 또한 첨단화 지능화 되어가고 있으며, 경제가 불안할수록 다양한 범죄는 늘어갈 수밖에 없다. 보험사기만 보드라도 보험금을 노린 살인 상해 화제와 선박사고 등 보험범죄가 날이 갈수록 늘어 가는 추세며 보험범죄로 누수 되는 보험금이 한해 우리나라만 공식적으로 약 7조원이 누수 되고 있으며, 비공식적으로 약 10조원으로 추정된다. 또한 전 세계적으로 지식재산권침해조사 시장은 약 한해 320조원 시장으로 추정되고 있다. 어느 나라든 국가가 국민의 가려움을 다 긁어줄 순 없다. 선진국은 사법기관과 경찰, 검찰이 부족해서 탐정법 & 민간조사업법이 법제도화 되고 있는 것은 아니다. OECD 가입국 중 유일하게 탐정 & 민간조사업법이 법제도화 되어 있지 않은 나라는 대한민국뿐이다. 대한민국은 1999년 16대 국회부터 “공인탐정”법을 법제도화 하려다 공인탐정법과 민간조사업법 두 용어 미결정으로 17대 국회로 넘어갔다. 2005년 8월 29일 대한민국 “민간조사업법 법제도화에 따른 공청회”를 거처 한국 최초로 탐정법이라 불리는 “민간조사업법”을 당시 여당 열린우리당 최재천 국회의원과 야당인 한나라당 이상배 국회의원이 동일한 법을 가지고 관리관청을 다투면서 국회 발의를 했다. 17대, 18대, 19대, 20대 국회까지 밀고 당기기를 지속하며 또한 관리감독 문제로 법무부와 경찰청이 힘겨루기를 하고 국무총리실 조정실까지 조정에 나섰으나 아직까지 결정을 못하고 있는 실정이다. 또한 변호사협회에서 법제도화를 반대 하는 분위기 탓으로 탐정법 & 민간조사업법은 제자리를 찾지 못하고 표류하고 있다. 이에 국민과 국가에 꼭 필요한 탐정법, 민간조사업법 제도화를 알리고 이사회 꼭 필요한 법의 존재가치를 인식하고 피해자와 가해자 뒤바뀌는 억울함을 줄이는데 큰 역할을 하는 민간조사원으로서 전문지식을 갖추어야 하며, 엄격한 관리감독이 필요하기에 법적 제도를 심도 있게 논의할 필요가 있으며, 학술적 깊이를 통한 학술연구와 실무여구를 지속적으로 연구 발전시켜 나가므로 증거자료를 분석하고 서치 하는 최고의 전문가로 거듭나 국민으로부터 사랑받고 신뢰받을 수 있는 민간조사업법 제도화를 깊이 있게 연구할 필요가 있다고 사료된다.

영문 초록

As society advances, crime is also becoming more advanced and intelligent, and the more unstable the economy is, the more diverse crime is bound to increase. Insurance crimes such as murder, injury, and ship accidents, which are aimed at insurance fraud alone, are on the rise day by day, and Korea alone officially has about 7 trillion won in insurance money, and it is estimated unofficially about 10 trillion won. In addition, the global market for intellectual property rights violations is estimated at 320 trillion won per year. No country can afford to scratch the itch of its people. The lack of law enforcement agencies, police and prosecutors in advanced countries does not make detective laws and civil assistance business laws legal. South Korea is the only OECD member that does not have the Detective & Civilian Assistance Act enacted. The Republic of Korea tried to legislate the Public Detectives Act from the 16th National Assembly in 1999, but it was moved to the 17th National Assembly due to the failure of the two terms of the Authorized Detective Act and the Civil Aid Business Act. On August 29, 2005, Choi Jae-cheon of the then ruling Uri Party and Lee Sang-bae of the opposition Grand National Party launched the Civil Aid Business Act, the first Korean law to be called the Detective Act, in a parliamentary motion against the same law. The 17th, 18th, 19th and 20th National Assembly remained behind, while the Justice Ministry and the National Police Agency struggled over the management and the Office of Coordination at the Prime Minister s Office to make adjustments, but have yet to make a decision. Also, the detective law & private aid business law has been stalled due to the lawyers association s opposition to the system. Therefore, it is necessary to promote the institutionalization of the detective law and the private assistance business law, recognize the existence value of the law that is essential to the people and the country, and to have expertise as a private investigator who plays a great role in reducing the injustice of victims and perpetrators, to discuss the legal system in depth as it requires strict supervision of management, and to continue to develop the scientific research and working conditions through academic depth, so it can be repeatedly analyzed and loved by the best experts.
