시민교육으로서 교양 법교육의 타당성에 대한 고찰

국문 초록

대학 교양교육에서 체계적인 법교육이 시행될 필요가 있을까? 기존 관련 연구는 이 사안에 대하여 상대적으로 관심이 적었다고 할 수 있다. 법학이라는 학문분과의 입장에서 법교육이나 법학교육이 교양교육 차원에서 필요하다는 연구는 있다. 그러나 보다 근본적으로 교양교육의 목적을 고려하였을 때, 교양교육에서의 법교육이 중요 사안이 될 수 있다. 제도적으로 보았을 때 대학도 법교육의 대상이 된다. 법교육지원법상 고등교육 법교육도 그 대상이고, 이는 시민교육 차원에서 이해될 수 있다. 그럼에도 대학에서의 법교육은 찾아보기 어렵다. 법교육 관련 기관과 학회 등도 대학에서의 법교육에는 관심이 적다. 대학과 법학자들도 대학에서의 법교육에 관심이 적다. 그러나 전통 교양교육의 목적은 시민교육이라는 점을 간과할 수 없다. 라틴어 리버럴아츠의 개념 자체가 “자유시민의 역량 또는 기술”이라 해석할 수 있다. 한국어 “교양”이라는 단어는 1910년대에 일본어에서 번역된 것으로 18-19세기 독일어 “Bildung”을 지칭한다. 이는 고대 그리스의 시민을 이상으로 보아 정치 공동체에 참여하고 자기결정 의사능력을 갖춘 자유로운 시민을 양성하는 데에 그 목적을 두고 있었다. 이러한 이상이 서양 교양교육의 역사에 지속하고 있다. 이에 따라 본 연구는 법교육과 교양교육은 사실 시민교육이라는 교육 목적을 공유하고 있기 때문에 대학 교양교육에서 법교육이 필요할뿐 아니라 타당하다는 점을 지적한다.

영문 초록

Is there a need for systematic legal education in liberal arts education? IIt can be said that the existing research has relatively little interest in this issue. From the standpoint of the academic branch of law, there are studies that show that liberal arts education needs to take legal education or law-related education. However, apart from this, when considering the purpose of liberal arts education, law-related education in liberal arts education can become an important issue. From an institutional perspective, universities are also subject to law-related education because higher-education is also the subject of the Legal Education Support Act, which can be understood in terms of civic education. Nevertheless, it is difficult to find law-related education in college. Law-related education institutions and academic societies have little interest in law-related education at universities. Colleges and legal scholars are also less interested in law-related education at universities. However, the purpose of traditional liberal arts education is civic education. The Latin term “liberal arts” itself can be interpreted as the competence or skill of a free citizen. The word “liberal arts” in Korean is translated from Japanese in the 1910s and refers to German “Bildung” in the 18th and 19th centuries. It was aimed at nurturing free citizens with self-determining capability and participating in the political community. It was based on the ideal of the citizens of ancient Greece. This ideal persists in the history of Western liberal arts education. Accordingly, this study points out that law-related education and liberal arts education actually share the purpose of civic education. Therefore law-related education is not only necessary but valid in university liberal arts education.
