공정선거를 위한 블록체인 전자투표 도입의 헌법적 고찰

국문 초록

코로나19의 대유행은 사람들 사이의 전염과 감염을 막기 위한 방법으로 ‘비대면’ 방식이라는 새로운 패러다임이 정치･경제･사회･문화 등 모든 영역에 변화를 가져왔다. 코로나19의 세계적 유행 속에서 실시된 2020년 4월 총선거는 온갖 방역대책을 수립하여 성공적으로 마무리되어 세계적인 관심을 끌었다. 한편 이미 오래전부터 논의되어온 전자투표 제도의 도입이 이뤄져 잘 정착되었다면 현장투표를 하는 선거는 애당초 불필요했을 것이다. 그렇다면 과연 무엇이 전자투표제도의 도입과 정착을 어렵게 하고 있었는가 하는 점과 그러한 문제를 극복할 기술적인 방법을 찾지 못했는가 하는 점도 분석이 필요할 것이다. 헌법상 선거의 원칙은 보통, 평등, 직접, 비밀, 자유선거다. 이 원칙들 가운데 ‘비밀’과 관련된 부분 그리고 투표조작의 가능성이라는 관점에서 ‘공정성’이라는 부분이 새로운 투표방식을 취하는 경우 해결해야 할 과제다. 왜냐하면, 비대면투표가 이루어지려면 현재의 과학･기술 발전단계에서 가능한 전자투표 제도가 이러한 의심을 해결하고 헌법상의 선거원칙들을 실현할 수 있어야 하기 때문이다. 최근 제4차 산업혁명시대에 가장 주목받는 기술 중 하나인 블록체인 기술은 그 불변적 특성과 분권적 구조로 인하여 많은 서비스 영역에서 소비자와 기업/정부 사이의 현존하는 불평등성에 대한 평등화 요소로서 중심적인 위치를 차지하고 있다. 이러한 블록체인 기술의 가능한 응용기술 중 하나가 바로 블록체인 전자투표 설계이다. 이 논문에서 투명성을 담보하는 투표함으로서 근본적인 전자투표의 특성뿐만 아니라 일정 수준의 분권적인 모형의 제시 및 유권자에게 허락된 범위 내에서 선거기간 동안 자신의 투표를 최신화하거나 변경할 수 있는 형태의 블록체인을 활용하는 잠재적인 전자투표 모형을 제시할 것이다. 나아가 블록체인 전자투표 모형이 가진 장점과 단점에 대해서도 살펴볼 것이다. 이렇게 제시되고 검토된 바를 토대로 하여 공직선거에 블록체인 전자투표제도가 정착되기 위해 필요한 전제는 무엇인지 또는 관련 법령의 개정은 어떻게 이루어져야 하는지를 검토하고 공직선거에서 블록체인 전자투표가 도입되고 잘 정착되기 위한 여건 조성과 시사점 등을 살펴볼 것이다.

영문 초록

The pandemic of COVID-19 is a way to prevent transmission and infection among people, and a new paradigm called the “non-face-to-face” method has brought about changes in all areas of politics, economy, society and culture. The April 2020 general elections, held amid the global wave of corona 19, drew global attention as they were successfully concluded by establishing all kinds of quarantine measures. Meanwhile, if the long-discussed e-voting system had been introduced and settled well, the election to hold on-site voting would have been unnecessary in the first place. Then, it is necessary to figure out what was making it difficult to introduce and settle the electronic voting system. It will also be necessary to analyze whether there has been no technical way to overcome such problems. The constitutional principle of election is universal, equal, direct, secret, and free election. Among these principles, the part related to “secret” and “fairness” in terms of the possibility of vote rigging are challenges that must be addressed in the event of taking a new method of voting. Because, in order for non-face-to-face voting to take place, the blockchain electronic voting system, which is possible in the current stage of scientific and technological development, must be able to resolve these doubts and realize constitutional election principles. Blockchain technology, one of the most notable technologies in the recent Fourth Industrial Revolution, occupies a central position as an element of equalization of existing inequality between consumers and businesses/government in many service areas due to its immutability properties and decentralized architecture. One of the possible applications of these block chain technologies is the block chain electronic voting design (schemes). In this paper, a transparent ballot box will present not only the nature of fundamental electronic voting, but also the presentation of a certain level of decentralized model and a potential electronic voting model that utilizes a type of block chain that can update or alter his or her vote during the election period to the extent permitted by voters. Furthermore, we will look at the advantages and disadvantages of the block chain electronic voting model. Based on these suggestions and reviews, we will review what the premise necessary for the establishment of the block chain electronic voting system in public office elections or how the revision of related laws should be made, and will look at the creation and implications of conditions for the introduction and well-established block chain electronic voting in public office elections.
