공무직의 복무윤리에 관한 연구

국문 초록

공무직은 정부나 공공기관에서 근무하는 무기계약직 직원을 말한다. 정부에서 근무하는 공무직의 경우, 무기계약직이므로 신분보장이 되어 있고, 근무에 따른 보상에 있어서도 노동관계법령이나 관리규정, 단체협약 등을 통해서 공무원과 큰 차이가 없는 제도의 적용을 받는다. 다만, 근로조건의 실질상 공무원과 차별받으므로 개선해야 한다는 요구가 많다. 그렇지만, 근로조건에 관한 논의에 비해 공무직의 복무의무에 관한 논의는 제기된 바가 없다. 고용노동부가 제시한 표준규정과 4개 기관의 규정을 비교한 결과 공무직에게도 공무원들에게 요구되는 청렴의 의무나 영리업무금지의 의무 등 복무의무들이 일부 요구되고 있다. 공무직은 수행하는 직무의 내용이나 근로조건의 제도적 틀에서 공무원과 구별된다고 보기 어려우므로 공무직에게도 공무원과 동일한 복무의무가 부여되어야 한다. 이를 위하여 공무직 전체를 관리할 수 있는 관리기본법이 제정될 필요가 있으며, 공무원에게 요구되는 복무의무가 구별없이 적용되어야 할 것이다. 또한 공무원들에게 요구되는 정치적 중립의 의무, 청탁금지의 의무도 부여되어야 한다.

영문 초록

The indefinite contract workers of Korea Government are guaranted retirement age, and the other working conditions including pay system based on the laws and regulations are almost similar with those of public officials. There are some studies for improving working conditions of indefinite conpractors, because, practically, there are discrimination between contract workers and public officials. However, there is not a study on the service duties of the indefinite contractors of Government. In standard management regulations maded by the Ministry of Employment and Labor and management regulations of 2 Central Government Departments and 2 Local Governments, there are some articles for duties in Management Regulation. But they are not enough compared to the service duties of public officials. Because it is hard to be different the contents of work and the system of working conditions of the indefinite contract workes with those of public officials, the duties of service of contract workers have to be strengthened as the same level of public officials service duties. Especially the duty of political neutral and the duty of solicitation prohibition must be obligated.
