지방자치법상 지방행정체제의변화와 향후 과제

국문 초록

2019년부터 우리나라는 본격적인 인구의 자연감소 시대에 들어섰다. 이로 인해 최근 우리 지방자치법은 큰 변화의 시기를 맞이하고 있다고 할 것이다. 이에 이 글은 1948년 제정헌법 이후의 지방자치법 개정사항을 시기별로 구분하여 분석하고, 그것을 토대로 오늘날 우리 지방자치법의 발전 방향을 제시하고자 하였다. 특히, 헌법 제117조 및 지방자치법 제2조 지방자치단체 종류 조문의 변화를 중심으로 하여 지난 70여년 간 지방행정체제의 변화과정을 면밀히 살펴보고자 하였다. 우리나라 지방자치의 변화상을 크게 인구증가 시대(도입기, 중단기, 재도입기, 도약기)와 인구감소 시대(발전기)로 구분하였다. 인구증가 시대의 지방자치법상 지방자치단체의 종류는 지방자치의 이념적･환경적 변화에 적극적으로 대응하면서 발전해 온 특징이 있었다. 인구감소 시대에서도 같은 방식의 대응이 이루어지고 있는 것으로 파악해 볼 수 있었는데, 다음과 같은 측면에서 새로운 시대에 대비한 보완 및 향후의 과제를 남기고 있다고 주장하였다. 첫째, 본격적인 인구감소 시대를 맞이하여 지방자치법 지도이념으로서 지방생존권의 도입을 주장하였고, 이에 대한 면밀한 검토를 향후의 과제로 제안한다. 둘째, 특례시･군 도입 기준에 관한 지방자치법 개정은 지방자치법 제2조 종류에 그것을 반영하는 방식으로 이루어져야 한다. 셋째, 특별지방자치단체는 인구과소지역의 규모의 경제 달성에 큰 도움이 된다. 따라서 정부 지방자치법 전부개정안에 따라 신속히 설치･운영하여야 한다. 다만, 이 글은 지방해정체제 개편에 관한 자치계층, 지방행정구역, 중앙-지방간 권한배분관계 등 다양한 논점들을 구체화하지 못하고 지방자치법상 지방자치단체 종류 조문에 의한 자치계층 및 유형에 대하여 면밀히 살펴보는 데에 더 집중하였다. 또 우리 지방자치법사에서 읍면의 자치단체 규정이 매우 중요한 의미를 지니고 의미를 지니고 있음을 발견할 수 있었으나 구체화하지 못한 한계가 있다.

영문 초록

From 2019, the Republic of Korea has become a full-fledged population-reducing country. This calls for a change in Local Government Law. This study analyzed the revision of the Constitution of the Republic of Korea and the Local Government Act, which were enacted in 1948. In addition, the direction of development of the Korean Local Government Act was suggested based on this. This was specifically focused on the changes in articles on the types of local governments under Article 117 of the Constitution of the Republic of Korea and Article 2 of the Local Government Act. The research method used deductive review method. Specifically, the enactment and revision of the Local Government Act from 1948 to 2020 were compiled and analyzed. The study divided the changes in local government in Korea into the era of population growth (in the period of introduction, middle, reintroduction, leap) and in the era of population decline (in the period of development). The era of population growth has been developed by actively responding to ideological and environmental changes in local government. It is understood that the same way of responding is being carried out in the era of population reduction. Some had detailed differences. The results and future tasks of this study are as follows. First, the Local Government Law in the era of population decline should introduce the right to survive (the right to local survival) of local governments as a guiding ideology. Second, in the provisions of Article 2 of the Local Government Act, special case of cities and counties shall be specified. Third, special local governments are of great help to achieve economies of scale in areas of overcrowding. Therefore, special local governments should quickly establish and operate. However, this research has limitations that have only been specified in part (Article 117 of the Constitution and Article 2 of the Local Government Act) of the discussion on the reorganization of the local administrative system. It also failed to specify important details in the history of local Government Laws. It means that synoecism is defined as a local government. This leaves it as a future research project.
