독일에서의 지방자치단체에 대한 국가의 행정적 감독과 사법적 통제

국문 초록

지방자치단체는 지역적인 자치권을 가진 독립된 공행정주체이면서 국가 통치구조의 본질적인 구성부분이라는 이중적 지위를 가진다. 따라서 지방자치단체의 자치권의 확대와 강화에 관한 논의가 진행될수록, 지방자치단체에 대한 국가감독, 특히 행정적 감독과 그 사법적 통제에 관한 국내법적 연구뿐만 아니라 비교법적인 연구도 더욱 활성화 될 필요성이 있다. 지방자치제가 활성화된 선진 외국들 중, 특히 독일은 지방자치단체에 대한 국가감독과 관련하여 심도 깊은 연구와 판례가 축척되어 있고, 개별 연방주들의 지방자치법에는 국가의 다양한 행정적 감독수단들이 규정되어 있다. 따라서 독일에서의 지방자치단체에 대한 국가의 행정적 감독과 사법적 통제에 관한 연구가 필요하다고 할 것이다. 이 연구에서는 우선 국가감독에 관한 일반적 고찰로서 독일에서 논해지고 있는 국가감독의 기능과 국가감독수행에서의 지방자치단체에 대한 친화적 태도의 원칙과 비례성 원칙에 관하여 살펴보았다. 또한 독일에서의 지방자치단체에 대한 적법성 감독의 내용과 범위를 바탕으로 개별 연방주의 지방자치법에서 규정되어 있는 적법성 감독 수단인 지방자치단체에 대한 국가의 조언, 국가의 정보권, 허가유보, 지방자치단체의 의결이나 명령에 대한 국가의 이의제기권, 국가의 직무이행명령권, 국가의 대집행권, 수임관의 선임, 지방의회의 해산, 지방자치단체의 장의 해직 등에 관한 내용과 그 사법적 통제를 취소소송과 의무이행소송을 중심으로 살펴보았다. 더 나아가 지방자치단체에 대한 국가의 합목적성 감독에 관한 수단으로서 국가의 지시권, 정보권 및 직접개입권의 내용과 그에 관한 사법적 통제 가능성에 관하여 살펴보았다. 무엇보다도 이 연구를 통하여 독일에서의 국가감독은 지방자치단체에 대한 친화적 태도의 원칙과 비례성 원칙에 기반하고 있고, 국가감독의 기능으로서의 자치행정의 적법성 유지기능 외에도 지방자치단체의 보호기능에도 그 초점을 맞추고 있음을 알 수 있었다. 또한 독일 연방주들의 지방자치법이 강력한 국가감독수단을 규정하고는 있지만, 지방자치단체에 대한 친화적 태도의 원칙 및 비례성 원칙을 근거로 이러한 감독수단들의 활용은 엄격하게 제한되어 있다는 것도 알 수 있었다.

영문 초록

Local governments have a dual status as an independent public administration entity with regional autonomy and an integral component of the national governance structure. Therefore, the more discussions on expanding and strengthening the autonomy of local governments proceed, the more necessary it is to promote the national supervision of local governments, especially the domestic legal research on administrative supervision and its judicial control, as well as the comparative legal research. Among advanced foreign countries where local autonomy is activated, especially Germany has accumulated in-depth research and precedents in connection with national supervision of local governments, and the local autonomy act of individual federal states stipulate various administrative means of supervision. Therefore, it would be necessary to study the administrative supervision and judicial control of local governments in Germany. In this study, the function of national supervision discussed in Germany first and the principle of friendly attitude and proportionality to local governments in the performance of national supervision were studied. It also looked at the contents and scope of the legal supervision measures for local governments and judicial control methods related to supervisory measures. Furthermore, it looked at the means of supervising the appropriateness of the state to local governments and the possibility of judicial control over them. Most of all, this study showed that national supervision in Germany was based on the principle of friendly attitude and proportionality to local governments, and that the focus was on the protection function of local governments in addition to the function of maintaining the legitimacy of autonomous administration as a function of national supervision. It was also found that although the German Federal States Local Autonomy Act stipulated strong national supervisory measures, the use of these means of supervision was strictly limited on the basis of the principle of friendly attitude and proportionality to local governments.
