일원제 자치경찰제도 도입 모델에 대한 자치성 검토

국문 초록

문재인 정부는 자치경찰제도 도입에 대한 논의를 지속적으로 추진해 왔으며, 21대 국회에서는 그동안 논의되었던 광역단위 자치경찰제도에서 일보 후퇴하여 일원화된 자치경찰제도 도입을 발표하였다. 국회에서 의원입법안으로 발표하였으나 이는 정부와 협의를 통하여 추진하는 것으로 정부와 국회의 공통된 법안이라 볼 수 있다. 일원화된 자치경찰제도는 기존의 지방자치성 강화를 위해 검토되었던 자치경찰제도와 달리 국가경찰기관에서 자치경찰사무를 추진하는 제도 도입이다. 이러한 일원화된 자치경찰제도가 과연 지방자치에 부합하는 가에 대하여 의문이다. 즉, 국가경찰기관이 지역의 경찰사무 중 일부 생활안전과 관련되는 사무를 자치사무라 하여 그 사무를 처리하는 것이 자치경찰이라 할 수 있는지 의문이다. 지방자치는 지역민이 스스로 자주적인 의사를 가지고 주민의 복리를 처리하는 것으로 현대 민주주의 사회에서는 모든 지역민이 직접 참여할 수 없어, 지역의 대표성을 가지는 자를 선출하여 지역사무를 처리하고 있다. 따라서 지방자치는 지역민의 의사가 직접 지역사무에 반영되어 자주적으로 처리하는 것이다. 그러나 현재 추진되고 있는 일원화된 자치경찰제도 입법안은 지역민의 직접 참여 없이 중앙정부의 국가경찰기관이 자치경찰사무로 정한 사무를 처리하는 제도이다. 자치경찰사무는 지방자치경찰이라는 표현을 사용하고 있으나, 그 집행기관은 국가기관이고 행정청 또한 국가기관이 담당하고 있다. 진정한 지방 자치경찰제도가 완성되기 위해서는 지역민이 스스로 자치경찰사무에 참여하고 지방자치단체가 그에 대한 책임을 가지는 것이다. 따라서 일원화된 자치경찰제도가 과연 지방자치에 부합하는지가 의문이며, 본 연구는 지방자치라는 자치성 관점에서 국회에서 입법안으로 발의된 내용을 검토하였다.

영문 초록

The Moon Jae-in administration has continuously been discussing the introduction of the autonomous police system, and the 21st National Assembly announced the introduction of a unified autonomous police system by retreating from the regional autonomous police system that had been working in discussion so far. Although the introduction was announced as a legislative bill by the National Assembly, it can be regarded as a common bill of the government and the National Assembly for it is pushed ahead through consultations with the government. The unified self-governing police system is to introduce a system in which the national police agency deals with the affairs of self-governing police, unlike the existing self-governing police system, which was reviewed to strengthen existing local autonomy. It is questionable whether the unified self-governing police system really fits with local autonomy. In other words, it is doubtful if it is possible to say that it is the autonomous police that the national police agency handles some of the local police affairs related to life safety as autonomous affairs. Local autonomy is responsible for the welfare of local residents with its own independent will. In the modern democratic society, all local residents cannot directly participate in their local affairs, so a person with local representativeness is elected to deal with those affairs. Therefore, it is local autonomy that local residents‘ intentions are directly reflected in their local affairs and the local affairs are handled independently. However, the unified self-governing police system legislation being currently in the works is a system in which the national police agency of the central government copes with the affairs of the self-governing police without a method for direct participation of local residents. Autonomous police affairs use the expression of local self-governing police, but its executive agency is the government, and the government is also in charge of administrative agency. In order for a true self-government police system to be completed, local residents should participate in self-governing police affairs on their own and local government should have its responsibility. Therefore, it is questionable whether the unified self-governing police system really fits with local autonomy. This study reviewed the legislative bill proposed by the National Assembly from the perspective of local autonomy.
