한국 전자감독제도의 활용 확대방안

국문 초록

2008년도에 한국에 전자감독제도가 도입된 지 10년 이상이 지났다. 외국의전자감독제도는 교도소 수용과밀 현상을 억제하고자 주로 경미범죄자를 대상으로 하는 재택구금 중심으로 운영되어 왔다. 그러나 한국은 재택구금방식의과정을 거치지 않고 곧바로 성폭력범죄와 같은 강력범죄자의 이동경로를 GPS 를 통해 감독하는 방식을 도입한 이례적인 국가가 되었다. 제도 운용 과정에서여러 가지 난관들이 많이 있었지만, 그 동안 기존 성폭력범죄자의 동종재범률을 크게 줄이는 성과를 거두었다. 한국의 교도소 과밀수용 문제도 이미 헌법재판소에서 위헌결정을 받을 정도로 심각한데 이를 해결하기 위해서는 교도소를 증설해야 하지만 상당한 예산상의 제약이 따르고, 또 교도소 신축에 대한 지역주민들의 반발 등을 예상할때 결코 쉬운 일이 아니다. 최근 과밀구금 문제를 해결하기 위해 교정 당국에서 가석방을 활성화하는 등 다양한 정책을 구사하고 있지만, 과밀구금의 근본적인 문제를 해결하는 데 한계가 있다. 이러한 시점에서 미결구금자나 가석방자에 대해 재택구금을 실시하자는 의견이 제기되었고, 마침내 2020년 1월 전자장치 부착법이 국회를 통과한 상황이다. 따라서 이 연구에서는 국내 전자감독제도 및 외국에서 실시되고 있는 재택구금제도를 검토하고 향후 재택구금제도의 활용방안에 대해 검토하고자 한다.

영문 초록

It has been over 10 years since the introduction of the electronic supervision system in Korea. The foreign electronic supervision system has been operated mainly on home detention mainly for minor criminals to suppress prison overcrowding. However, Korea has become an unusual country that has introduced a method of supervising the trajectory of violent criminals such as sexual assault through GPS without going through the process of home detention. In the meantime, there were many difficulties during the 10 years of the operation of the system, but now it has achieved a significant reduction in the rate of homosexual recidivism of existing sexual assault criminals. The problem of overcrowding in Korea is already serious enough to receive an unconstitutional decision from the Constitutional Court. To solve this problem, it is necessary to add prisons, but there are significant budgetary constraints, and it is never easy to anticipate local residents backlash against the new prison construction. This is not. In order to solve the problem of overcrowding, correctional authorities have recently implemented various policies, including the release of parole, but there are limitations in solving the fundamental problem of overcrowding. At this point, in the recent 10 years of experience in operating the electronic supervision system, opinions were raised to impose home detention for unsettled prisoners or paroleers, and finally, in January 2020, the Electronic Device Attachment Act passed the National Assembly. . Therefore, this study intends to examine the operational status of the home detention system in foreign countries and to examine the future use of the home detention system.
