교과용도서의 개발 및 수정에 관한 법적 절차 개관

국문 초록

본고에서는 교과용도서의 개발에 관한 법적성격을 검토하고 교과용도서의 수정과 관련한 법적 절차를 개관하였다. 국정도서는 실무상 연구기관이나 대학 등에 위탁하여 개발하게 되는데 이는 민법상 위임에 해당하고, 검정도서는 검정기준을 미리 공고하여 사인이 저작한 도서를 그 기준에 따라 심사확인 한 후 검정도서로서의 지위를 인정하므로 조건부 현상광고와 행정행위로서의 특허에 해당한다. 2020. 1. 신설된 자유발행도서의 개념을 도입함으로써 외연이 확대된 인정도서는 이미 발행된 도서를 교과서로 사용하게 해 줄 것을 신청하면 그에 맞는 심사기준을 설정하여 인정여부를 결정하는 측면에서 전형적인 특허에 해당한다. 그 결과 절차적인 관점에서 국가주도형 교과서인 국정도서에서 민간주도형 교과서인 인정도서로 갈수록 민사영역에서 공법영역으로 법적성격이 이동하고 있고 검정도서가 그 중간 영역에 자리매김할 수 있음을 알 수 있다. 수정과 관련하여 국정도서는 교육부장관이 직권으로 수정할 수 있고, 검정도서는 저작자나 발행자에게 수정명령을 할 수 있다. 국정도서 수정과 관련하여 교육부 공무원 등이 관련 서류를 사실과 다르게 조작했다는 이유로 기소된 사건에서 형사법적 쟁점은 변론으로 하더라도 교과용도서 관련 법령과 위임법리에 따라 손해배상의 민사법적 책임조차 물을 수 있는지에 대해 근본적인 고민이 필요해 보인다.

영문 초록

In this paper, the legal nature of the development of textbooks was reviewed, and the relationship between rights and obligations related to the revision of textbooks was reviewed. The national book is developed by entrusting it to research institutes or universities in practice. The certified books are subject to conditional status advertisements and patents as administrative acts as they are recognized as a certified book after reviewing and confirming the book written by the autographer according to the standard by previously notifying the standards for verification. When an application is made to use a book that has already been issued as a textbook, the accredited book is a typical patent in terms of determining whether or not to accredit by setting the appropriate examination criteria. As a result, from a procedural point of view, it can be seen that the legal character is shifting from the civil domain to the public law domain as the state-led textbook goes to the private-led textbook, and the certified books can be positioned in the middle. The National book can be revised by the Minister of Education, the author or publisher of the certified books can be ordered for revision. In the case of the June 6, 2019 prosecution for the forgery of private documents and the violation of the exercise of the right to abuse the authority, the officials of the Ministry of Education, etc., related to the revision of the national policy, made the relevant documents different from the facts. Even if the issue of criminal law is a pleading, it will be questioned whether even civil liability for damages can be held in accordance with the laws and regulations related to the textbook.
